Gates: New Windows 8 system is 'very exciting'

(AP) ? Microsoft founder Bill Gates on Thursday called the new Windows 8 operating system scheduled for release next month "a very exciting new product" and "a very big deal" for the world's largest software maker.

Gates said in an interview with The Associated Press that he is already using Windows 8 "and I'm very pleased with it."

Windows 8 is Microsoft's biggest overhaul of Windows in more than a decade and the company's attempt to stay relevant and exciting in a world where mobile gadgets have started to overshadow personal computers.

"Hardware partners are doing great things to take advantage of the features," Gates added. "It'll be a big deal."

Microsoft Corp. will release Windows 8 on Oct. 26 along with a new version of Internet Explorer.

Gates responded to a question about Windows 8 during an AP interview about the Bill and Melinda Gates Foundation's key role in a new global campaign to eradicate polio.

Windows 8 will replace Windows 7 on practically all personal computers sold to consumers.

It features major changes in the way consumers interact with their machines, and versions of it will also run on tablet computers and smartphones.

Although Microsoft has grown into much more than a maker of computer operating systems ? providing computer services to corporations and Xbox gaming machines to game enthusiasts ? Windows still accounts for a significant chunk of the company's annual revenue.

In 2011, Microsoft's "Windows & Windows Live" division generated 27 percent, or $19 billion, of the company's $69.9 billion in annual revenue.

Could Disney be the new Netflix? | Digital Trends

Forget Apple and Amazon: The new Netflix might come from the House of Mouse, with one analyst suggesting that Disney is already well-placed to launch a streaming video-on-demand service to take the SVOD crown.


For years, a question on many people?s lips in the entertainment industry has been ?Who is going to manage to take on Netflix and win?? The list of companies that many hoped would be able to manage to not only get a foothold in the increasingly-lucrative Video on Demand market, but manage to turn that foothold into something much more longterm and permanent, has been long throughout the years, from big names to Apple and Amazon to less obvious suggestions like Walmart and Blockbuster. According to one new report, however, we?ve all been overlooking a major media player who might even have the infrastructure in place to move into the market already: The Walt Disney Company.

Todd Juenger, a business analyst with Sanford C. Bernstein, believes that the only thing keeping Disney from being a major force in streaming content at this point is lack of desire. Describing the possibility for Disney to move into the area as a ?hidden treasure,? Juenger wrote in a report to investors that ?the time is ripe for Disney to re-imagine their sleepy SVOD service (Disney Family Movies) into a full-blown, premium Disney-branded SVOD service.?

For those unfamiliar with Disney Family Movies ? I suspect that may be all of you who don?t have children ? it?s a streaming video service that describes itself as ?a subscription video on demand service for one very low monthly price: great feature movies, shorts, featurettes and bonus materials, at your fingertips.? In other words, the chance to see everything you?d get on a Disney DVD ? including the special features, unusually for a streaming service offering ? as an On-Demand offering from major television and cable providers (Instead of being available online, potential users are directed to contact their carriers to find out if the service is available for them).

The problem with Juenger?s prediction is that Disney?s offerings are currently tied up in a deal with Starz, which in turn makes their movies available to other VoD services, including Netflix. He has a simple solution to this problem: Break the Starz deal. ?Full realization would likely require abandoning the Starz output deal,? he admitted in his report, adding that the potential earnings from a revitalized Disney Family Movies offering ?would be easily superior? to the income the company sees from the current licensing deal. ?At 12 million [subscriptions], DFM would add $475 million incremental operating income,? he explained.

The suggestion is a fascinating one, not least of all because it actually makes a fair amount of sense. Disney hasn?t made any noises about being concerned about this kind of plan in the past, but Disney Family Movies does provide an existing framework to build from, and with a bank of content that not only includes the animated Disney movies, but also ABC television content, Marvel Studios and Pixar, there?s a lot of reason for customers to sign up to such a service. Maybe it?s not such a crazy idea, after all.

Senate to vote on Rand Paul?s foreign aid cutoff

After weeks of pressure from Kentucky Republican Sen. Rand Paul, the Senate is scheduled to vote on cutting off U.S. aid to Pakistan, Egypt and Libya.

A resumption of aid would be contingent on Egypt and Libya arresting the people responsible for the recent embassy attacks and turning them over to American authorities.

Pakistan would be required to release an imprisoned doctor who helped the CIA identify Osama bin Laden.

Paul had threatened to hold up all Senate business until the measure came up for a vote.

?In no way should the United States government be sending money to governments who are not our ally, who blatantly do not respect our country, and who work to compromise the safety of our allies and citizens abroad,? the senator said in a statement. ?I am pleased that the Senate leadership has listened to my pleas for an end to this and have agreed to debate and vote on this pressing issue.?

?Some argue that without foreign aid we?ll have war,? Paul said in debate Friday. ?I?m arguing that because of foreign aid we have war.?

Paul has been at the forefront of a growing conservative push against foreign aid to governments viewed as unreliable allies.

The Senate?s Democratic leadership and some Republicans have resisted this effort.

?Rand Paul is one nice fellow, but I bet you he?s never talked with CIA Director General Petraeus about what would happen if we cut our aid off to Pakistan,? South Carolina Republican Sen. Lindsey Graham told reporters at a Politico event Thursday. ?It?s 90 percent popular, but I can show you things in history that were 100 percent popular that were really bad ideas.?

In order to get a vote on his foreign aid cuts, Paul threatened to filibuster a six-month government funding bill and placed holds on ambassador nominees for Iraq and Pakistan.

A vote is expected at around midnight Saturday.

(AP) ? The lawyer who ran the Sept. 11 victim fund and other major victim compensation efforts has been hired by Penn State in its effort to settle personal injury claims related to former assistant football coach Jerry Sandusky's molestation.

Penn State said Thursday that it retained the Washington, D.C., law firm led by Ken Feinberg for what the university described as an effort to resolve all litigation, including claims that have not been filed, by the end of the year.

Feinberg also helped resolve claims that arose from the BP oil spill in the Gulf of Mexico, the Virginia Tech massacre and the Vietnam War defoliant Agent Orange. He declined a phone interview.

At least four lawsuits are in the works against Penn State over Sandusky, who is scheduled to be sentenced next month for sexually abusing 10 boys.

Lawyers for Sandusky's victims from the criminal case and other potential claimants had said recently that the school hadn't followed up on its pledge to settle the civil claims quickly and fairly. Attorneys told The Associated Press this month that they had very limited contact with the university and, if that continued, more lawsuits were expected.

Philadelphia lawyer Joel Feller, part of a team that represents four of the 10 victims in Sandusky's criminal case, as well as Sandusky's adopted son Matt Sandusky and other claimants, said he was waiting to learn more about how the school plans to proceed.

"Whether this is a positive or negative step will be determined solely by Penn State taking responsibility for the compensatory and punitive damages owed to these young men," Feller said.

St. Paul, Minn., attorney Jeff Anderson said: "Any action toward bringing resolution and transparency is better than no action, and actions speak louder than words."

In a statement released by Penn State, Feinberg said his law firm would not be administering a compensation fund and has no authority to compel any settlement.

"We will merely facilitate the effort and only in those cases where individuals and their lawyers are so inclined," Feinberg said. "Having managed similar cases in the past we are confident we can help all parties involved in this matter and are pleased to have been selected for such an important role."

Penn State announced the day of Sandusky's conviction in June that it wanted to "privately, expeditiously and fairly" settle with Sandusky's victims, but school officials have not disclosed how they hope that will work.

After a student forum on campus Wednesday, university president Rodney Erickson said the school was developing a process "fair to everyone" that deals with the victims in a just manner. He said funding would be from insurance and internal sources, and not drawn from tuition, state appropriations or private donations.

Williamsport lawyer Cliff Rieders, who has filed paperwork initiating a lawsuit against Penn State over a client's alleged abuse at Sandusky's hands, said he was waiting to learn more.

"It really depends what he's given to work with by Penn State," Rieders said. "If he's going to come in and try to muscle settlements that aren't reasonable, then I think it's a terrible idea."

An adequately funded program that accounts for the realities of the Sandusky scandal, Rieders said, could be a good idea.

Tom Kline, a Philadelphia lawyer who represents a young man who testified against Sandusky at trial, said a university lawyer called him about Feinberg late last week.

"I told them I had a lot of respect for Ken Feinberg and his firm, and I thought it was a constructive step," Kline said.

Feinberg explained his victim compensation work in his new book, "Who Gets What: Fair Compensation after Tragedy and Financial Upheaval."

He writes that more than $7 billion in taxpayer money was used to pay survivors of the 2001 terror attacks, with an average award for death about $2 million, for injury about $400,000. Ninety-eight percent of claimants participated, and just 94 families opted out so they could sue.

After the Virginia Tech shooting, $6.5 million was distributed among 32 families, including five faculty members, using a methodology that took into account the length of hospital stays for those who survived.

The BP spill led to establishment of the Gulf Coast Claims Facility, which as of March had paid more than $6 billion to some 169,000 claimants.

Given Sandusky's age of 68, and that he was convicted of 45 counts, many of them serious felonies, he will likely receive a state prison term that will keep in behind bars for the rest of his life.

Green Blog: America's Greenest Presidents

What do Theodore Roosevelt, Richard M. Nixon and Jimmy Carter have in common? They are viewed as environmentally progressive presidents ? at least by the 12 groups that ranked them in a survey released this week. Still, the challenges faced by presidents who stand up for the environment have shifted greatly over time, some of those organizations point out, making it hard to compare one leader?s achievements with another?s.

Corporate Knights, a media and financial services company that promotes ?clean capitalism? for companies, asked 12 leading environmental groups to name the three presidents they felt did the most for the environment and to rank them from first to third. Point values were assigned to each rank. Theodore Roosevelt was the overwhelming victor, scoring 28 points; Richard Nixon was a distant second with 15; and Jimmy Carter followed with 12.

Perhaps most strikingly, of the 44 presidents who have held office over the last 223 years, only eight received votes. The others, ranked in order, were Barack Obama, Thomas Jefferson, Gerald R. Ford, Franklin D. Roosevelt and Bill Clinton.

Julian Zelizer, a professor of history and public affairs at Princeton, said that Teddy Roosevelt was a predictable top choice. ?He really initiated a lot of the conservation programs,? he said, including setting aside dozens of forest preserves for protection as well as wildlife refuges and venerated national parks and monuments like the Grand Canyon and Yosemite.

To this day, Dr. Zelizer said, Roosevelt remains a popular figure because of his rugged persona as an explorer and a ?man?s man? who loved the outdoors.

?I think above all, he created an ethic in Americans to visit, explore environments,? said Michael Brune, executive director of the Sierra Club, one of the 11 organizations for which Theodore Roosevelt was the top choice.

While memories of Nixon?s record (beyond the Watergate scandal) have faded for many Americans, any environmentalist with a sense of history is mindful of the pathbreaking protections he championed, including the creation of the federal Environmental Protection Agency and his signing of the Clean Air Act and Marine Mammal Protection Act.

Mr. Carter wins points for supporting Superfund legislation for the cleanup of toxic contamination and protecting swaths of land in Alaska. Then there were his appeals for energy conservation, said Robert Engelman, president of the Worldwatch Institute, which was the only group to give Mr. Carter the highest ranking.

In a landmark television speech in April 1977, Mr. Carter exhorted Americans to rein in their consumption of gasoline and electricity. ?We must not be selfish or timid if we hope to have a decent world for our children and grandchildren,? he said. ?We simply must balance our demand for energy with our rapidly shrinking resources.?

?No other before or since has asked Americans to consume less energy than they do,? Mr. Engelman said. The pitch was not a popular one, however.

?He was laughed at then, and he is laughed at now,? he said. ?No one would have the courage to make that point now.?

Dr. Zelizer argues that land protection was an easier sell for presidents in the not-too-distant past because the goal seemed straightforward and could generate some popular enthusiasm. ?Now we?re in an era when that enthusiasm has gone.? he said. ?A lot of the time, problems are more prevalent in the minds of Americans than the possibilities.?

Today, some major environmental goals ? reining in the greenhouse gas emissions that contribute to climate change, for example ? seem more abstract, Mr. Engelman said. Because the goal is mainly to avert disaster for future generations, mustering support is one of the hardest things to do politically, he added.

Another problem today, said Mr. Brune of the Sierra Club, is the blurring of issues, or what he calls ?manufactured confusion.?

?You have climate skeptics that are deliberately and intentionally trying to make it appear like a clear environmental issue is up for debate? ? even though a scientific consensus exists on human-induced global warming, he said. Such efforts, abetted by money flowing from the coal, oil and gas sectors ?pollute the political process,? he said.

Still, Mr. Brune points out that conflicts over the environment have a long history in the United States. At the turn of the last century, ?you had railroad interests that were fighting for more exploitation,? he said. ?You had even more crass examples of all of these extractive industries literally buying members of Congress.? The main difference between now and then, he said, is that more industry money is flooding the political scene than ever before.

Mr. Engelman observed that partisanship on environmental matters, with Republicans pitted against environmentally minded Democrats, is a more recent trend. ?Much of the environmental legislation that was passed in the 1970s had very bipartisan support,? he said. The pendulum began to shift after 1980, he said, with environmental protections cast by Republicans as a form of regulation and taxing. Yet addressing climate change will require both, he said.

A sharp divide in Congress between Democrats and Republicans and an entrenched aversion to compromise have made it difficult for President Obama to push through ? or on the 2012 campaign trail, even mention ? some of the legislation and regulatory steps he favored early in his administration. ?If you look at Clinton or Carter or Nixon ? every single president was able to sign legislation that Congress passed,? Mr. Brune said. ?Go through each one.?

?Obama doesn?t have that,? he said. ?He has to do it in the face of this head wind from Congress.?

On another level, judging success by markers like pristine forests, clean air and protected whales may be simplistic from today?s perspective. The landscape is more complex and more challenging now, Mr. Brune said, although he remains hopeful.

?I like to think that the politicization of energy and environmental issues is a temporary ailment that afflicts our society,? he said.

AT&T under fire for FaceTime pay policy

A group of public interest organizations are preparing a complaint against AT&T for violating net neutrality rules by blocking access to a video-conferencing application.

In a letter to AT&T, three groups ? Free Press, Public Knowledge and the New America Foundation's Open Technology Institute ? assert that the telecommunications giant is running afoul of Federal Communications Commission regulations by charging a premium for access to FaceTime, an Apple program available on iOS devices. FaceTime is free via Wi-Fi, but with iOS 6, due out this week, it can be used over a cellular carrier's network.

"We respectfully request that AT&T reconsider its behavior and the impact that blocking FaceTime will have on its customers, particularly the deaf and hard of hearing, as well as all who use this application to communicate with family and friends over the Internet," the letter reads.

"Making mobile use of the application available only to those customers who pay for unlimited voice and text messages harms individuals and innovation alike."

Spokesmen for AT&T did not respond to request for comment.

Under the FCC's guidelines, the subject of any complaint must be notified 10 days before a complaint is filed. If the public interest groups cannot convince AT&T to come to a resolution, the complaint will either be heard by the FCC's enforcement bureau or along to an administrative law judge, John Bergmayer, senior staff attorney at Public Knowledge told TheWrap.

Bergmayer said that unlike Sprint and Verizon, AT&T does not allow iPhone users to access FaceTime over cellular?unless they subscribe to one of its "Mobile Sharing" plans. He said that violates open Internet rules that prohibit companies from blocking these types of applications on their mobile networks.

"There's really no factual dispute about what AT&T is doing, we just have to see if they agree their behavior is against the open internet rule," Bergmayer said.

Bergmayer said a resolution could come anywhere between 45 days and several months.

A look at telecom-industry subscriber reports

Telecommunications companies have been releasing their earnings reports for the latest quarter. Here is a summary of reports for selected telecommunications companies and what they reveal about their own and the industry's prospects.

? July 19: Verizon Communications Inc. says its wireless unit gained a net 1.2 million subscribers ? a strong result in an industry where subscriber gains have tapered off now that nearly everyone has a cellphone. Of the new subscribers, 888,000 were on contract-based plans, which are the most lucrative. Verizon Wireless has 94.2 million retail subscribers. The profit margin at Verizon Wireless was the highest ever, as average monthly fees for contract-signing subscribers rose 3.7 percent to $56.13. Verizon is benefiting from the growing popularity of smartphones, which come with data fees.

? July 24: AT&T Inc. says it saw declining smartphone sales, leading to the best profitability ever in its wireless arm as it saved on phone subsidies. It activated 5.1 million smartphones in its latest quarter, down from 5.5 million a year ago. Much of the decline came because AT&T subscribers are holding on to their phones longer. AT&T added a net 320,000 subscribers on contract-based plans in the quarter. However, more than half of the new subscribers were tablet users, who pay less than smartphone users.

? July 26: Sprint Nextel Corp. reports it was successful in persuading smartphone subscribers to pay up for "unlimited data" service, and its service revenue zoomed, beating estimates. Sprint activated 1.5 million iPhones in the quarter, the same number as in the first quarter. By contrast, AT&T and Verizon saw a drop in iPhone activations as the excitement around the latest model, the iPhone 4S, cooled. Sprint is the only one of the four national wireless carriers that still offers unlimited data service, though it offers relatively slow data speeds.

MetroPCS Communications Inc., a provider of contract-free service, says it lost about 186,000 subscribers to end the quarter at 9.3 million.

? July 31: Frontier Communications Corp. ended the quarter with 3.1 million residential lines, down about 67,000 from the previous quarter.

? Aug. 1: Comcast Corp. says it added 158,000 phone customers to end the quarter with 9.7 million.

? Aug. 2: Time Warner Cable Inc. says it added 45,000 residential phone customers to end with 5 million.

? Aug. 3: U.S. Cellular Corp., a unit of Telephone Data and Systems Inc., lost a record 48,000 subscribers from contract-based plans in the quarter. That was partly offset by a gain of 20,000 contract-free customers. The company ended the quarter with 5.8 million customers, making it the seventh-largest cellphone company in the country.

? Aug. 6: Leap Wireless International Inc., the nation's sixth-largest cellphone carrier and operator of the Cricket brand, says it lost 289,000 customers during the quarter to end with 5.9 million.

? Aug. 8: CenturyLink Inc. says it had 14.1 million access lines, a loss of 234,000 during the quarter.

? Aug. 9: T-Mobile USA, a unit of Deutsche Telekom AG, says it lost a net 205,000 subscribers in the second quarter, a record for the period. Among phone subscribers under contract, it lost 557,000 subscribers, also the highest number of the second quarter.

Windstream Corp. says it has 2.9 million phone lines. It lost about 29,000 during the quarter.

? Aug. 21: MetroPCS, a cellphone company that targets low-income urban households, says it's cutting the price on its unlimited data service, going against the flow of the biggest phone companies, including AT&T and Verizon. MetroPCS has just activated a new fourth-generation, or "4G" data network, leaving it with some spare capacity.

? Aug. 22: T-Mobile says it will start selling an unlimited-data plan again on Sept. 5, after stopping sales of such plans early last year. T-Mobile had been calling all its data plans "unlimited," but once a customer hits a certain level of usage in a month, it would slow down speeds drastically. Under T-Mobile's new unlimited plans, all data would be at maximum speed.

IDES

So, I have this idea for a roleplay. Basically, the gist of it goes something like this:

Humans have finally discovered deep space travel by way of "Jump Gate" technology; ring-shaped passageways that allow ships to be hurled into the far reaches of space. Humans, being the impulsive and headstrong beings they are, eventually begin to excavate the furthest reaches of the galaxy. Colonies are established, corporations dig in and establish their colonial branches, people start businesses and make homes. And of course, extraterrestrials are discovered; some friendly, others not so much.

A collective government and military are formed by the combined human nations, birthing the United Earth Coalition (UEC). Battles are hard fought; some hard won, others easily lost. The humans are unrelenting in their plight to make a footprint on the galactic scale. Wars with alien species are spreading the name of the humans across the universe, and many alien species revere these new creatures as monsters. With acts of diplomacy, extraterrestrial societies come to welcome and aid the humans in their journey to traverse the stars, signing peace treaties and calling truces with formerly hostile alien nations, thereby rendering the UEC obsolete and giving rise to the Allied Galactic Civilizations Concordance (AGCC). However, aligning themselves with aliens caused a rift in the AGCC: many representatives of the nations that made up the UEC wanted to secede from the new found AGCC, and therefore broke off to form their own government: The nations of Eastern Europe and Asia make up the Human Space Expansion Federation (HSEF), while the rest of the nations remained in the Concordance.

War between the AGCC and the HSEF was inevitable, and the HSEF had more than enough manpower to form a very sturdy and hard-to-sever military, while its unified government ruled with intelligent and meticulous foresight. It seemed this new government couldn't be taken down, even with the combined forces of the Concordance and the many extraterrestrial forces they had allied themselves with.

Beyond the sight of any mortal creature, however, hovers above the workings a race of beings called the Aeons: all-knowing and very powerful, these beings have watched over this Phase of existence with scrutiny. The humans were, in their eyes, a ravenous species that would stop at nothing until everything was theirs. So, it seemed the time came to unleash their fail-safe: Argus. Their plot was to end this Phase by unleashing Argus upon the universe, collecting the souls of this being's Claims and use them for fuel to construct the next Phase.....

This had been done three times previously.

Now, with a universe at war, people struggling to live among the stars, and discovering more and more alien species that wanted to eradicate them, the beings of the universe must race to stop this plot of the Aeons. The masters of this Phase have selected a single individual to release Argus from his slumber, a being known as the Catalyst. If the Catalyst isn't stopped, then existence is done for, and this Phase.....shattered.

So, if this seems interesting, I'd love to hear back from you guys. Collaboration is a must, and this story needs to be heavily fleshed out and dissected before it can be a functioning roleplay. Science fiction war and a race to defy the will of the gods. What more does it need? We'll find out. Hopefully you like it enough to want to play in this realm. You should.

The Arkansas Project ? The Anatomy of Corruption, Bill Walker Style

I reported on July 18th that the Legislative Council?s Personnel Services committee was reviewing the hiring of Miss Clara Taylor?a woman who was hired to serve as a sign language interpreter for the state, despite her lack of credentials for the position. ?That review has now been conducted and completed by the Office of Personnel Management (OPM) and has produced this 15-page document which is full of fun facts for taxpayers.

Now, this report is filled with oodles of background information and other facts that are relevant to this situation, but not necessarily critical to our understanding of the corruption at work here. A synthesis of this report follows that highlights the unethical actions. To begin, let?s identify the key players.

The OPM review included conversations with the staff of the Department of Career Education:

1. Clara Taylor was hired for a position that she did not apply for and that she was unqualified for. ?The interpreter position became vacant on October 1, 2011. The position was advertised through the state?s hiring website from November 22 through December 5th, 2011. ?The review revealed that Miss Taylor?s application was dated August 2, 2011?nearly two full months before the interpreter position was vacated?and the position listed was ?Rehab Program Coordinator? which is, ironically, the same position that had just been filled by the previous interpreter.

After the application process ended, 9 applicants were identified as qualified for the position, based on these criteria: ?The formal education equivalent of a bachelor?s degree in special education, social work, or a related field.? ?Miss Taylor lacked the degree (thus, you will recall from our previous reporting that she was seeking a taxpayer-funded degree). ?Preferred qualifications included ?National Certification preferred, minimum qualification of a QAST level 3 or above.? ?Miss Taylor had no certification and scored less than a 1 on the QAST.

Of the 9 qualified applicants, 8 were selected for interviews. ?As January rolled around, 9 interviews were scheduled?9 interviews, but only 8 interviewees? ?Insert: Clara Taylor. ?Her name appeared in the list of interviewees for January 5th, despite not being listed as one of the 8 interviewees from the website applications. ??How did this happen?

2. Miss Taylor?s application was artificially inserted into the final round of applicants with a predetermined outcome.

According to the report, on January 13th, Miss Taylor?s name was placed on a list of top 3 candidates via a memo from David McDonald to Robert Trevino. ?Taylor was ranked #3. ?On the same day, Taylor?s name appeared on a letter from Carl Daughtery recommending that Taylor be hired for the position.

McDonald told OPM that he was asked, by whom we do not know, to notify the central office if Clara Taylor?s application was part of the interpreter applicants. ?He said he did not receive her application, at which point he was instructed to insert it: ?an HR staff member brought Ms. Taylor?s application to him. ?It was a copy of the original application for the Rehab position, not the interpreter position. ?McDonald was told to send the names of the top 3 applicants to his superior, Daughtery, and that one of those names was to be Miss Taylor.

Pamela Harris, the agency?s HR administrator, said that after the closing date for the interpreter position and after all qualified applicants had been sent to McDonald for interviews, Walker told her to send Taylor?s application to McDonald. ?Walker even told her where to find the application. ?Harris also said that Daughtery told her that he was going to tell McDonald to insert Taylor?s name into the list of top 3 candidates?and that Taylor was going to be selected.

In his statement, Daughtery said he did not know that the application was a copy of the Rehab application, but that he ?recalled that Taylor had mentioned she wanted to apply for the interpreter position.?

Pamela Harris, the agency?s HR administrator, told OPM that Walker had wanted Taylor to be hired for the Rehab position that she originally applied for, but Daughtery had intervened due to Taylor?s lack of qualifications.

3. Agency officials clearly knew that Taylor was unqualified for the interpreter position. ?

After the applicants were all tested and scored, Walker contacted Harris to discuss the interviews. ?Harris told Walker that Taylor was unable to translate the signing video and recommended that Taylor not be hired. ?Walker told her that Taylor was going to be hired anyway.

In the interview with Mr. Trevino, featured on pages 1 and 2 of the report, we hear a familiar refrain: ?The weight of the interview score is a factor but not the final determining factor? in the department?s hiring process. ?This is a line Walker himself used often in his defense of Taylor?s hiring over the past several months, and he used it again in his own testimony to OPM. ?Trevino said that applicants can ?tell a compelling story that can weigh heavily if that applicant does not meet other qualifications? (or any of the qualifications, in the case of Miss Taylor).

4. Miss Taylor was incapable of performing the duties of her job.

Taylor began her work on February 19, 2012. ?Part of her duties included signing for staff meetings. ?After one meeting, the deaf employees asked McDonald what he said during the meeting because ?they did not understand anything Ms. Taylor signed.?

5. Agency officials, other than Walker, were aware of conflicts of interest.

Following the interviews of the applicants, McDonald voiced his concerns about Taylor?s employment at Walker?s funeral home and their personal relationship to Daughtery. ?Daughtery then asked McDonald to provide the usual memo with the top candidates? names, which he said should include Taylor?s name, and together they would ?make the best decision for the agency.?

6. Bill Walker lied when he said he was not involved in Taylor?s hiring.

Regarding the hiring of Taylor, Walker told OPM reviewers that he ?did not encourage, ask or tell anyone to interview or hire Clara Taylor??but the evidence demonstrates that this is false.

Daughtery told OPM reviewers that he contacted Walker about Taylor because Walker was a reference for Taylor?however, Walker?s name is not listed on Taylor?s application or resume. ?Daughtery also said that Walker gave Taylor ?a very good reference and recommendation.? ?OPM asked Daughtery if he thought Taylor was the best qualified for the position. ?He said he did not think so, until he met with Walker.

Walker also told OPM he believes her hiring was ?a good fit, a good choice??comments he has since walked back.

The injustices and administrative incest evidenced here in this account are fairly obvious. What is less obvious is why this type of mismanagement, deceit, and corruption is being tolerated by the Beebe administration. ?Thankfully, Taylor has been removed from her position. ?Unfortunately, she was simply moved into another job and I have less confidence than ever that she will be replaced by an interpreter that is capable of fulfilling the duties of the job.

We have already caught Bill Walker publicly lying to lawmakers. ?Now it appears he has made the state vulnerable to litigation from the applicants for this position who were wrongfully overlooked based on their race or simply their lack of influence with Walker. ?The human resource law violations here are too numerous to count. ?If the governor will not act to clean up this agency, it?s time for lawmakers to start calling for Walker?s removal. Arkansas taxpayers deserve better.

Some dramatic tales of quitting jobs

Joan Clear quit her job as marketing director for a consulting company in the early 1990s, but she still remembers the day vividly.

Clear, who is now 67, had spent the past year and a half working for a man who she said was mean, insecure and a terrible communicator. The situation has grown so bad that one day she found herself in tears, a very uncommon occurrence for her.

That?s when she hatched her plan to quit.

Her opportunity came when her colleagues had gathered for a national marketing meeting. Clear said she told them they were going to start with a lesson in the power of language.

She then gave her hated boss an unabridged dictionary and told him to turn to the ?P? section.

Then, she recalls that she said, ?Now, I want you to look up the word piss-ant, and you?re going to find your name after the colon.?

It took him a second to understand what was going on, but when he did she said he turned bright red. That?s when she told him to do everyone a favor and have a heart attack.

?To this day I still remember just how much fun it was,? Clear said.

Of course, most experts will tell you that the correct way to leave a job is to first secure a new one and then offer two weeks? notice, along with the usual niceties about how you?ll miss everyone and you learned so much.

But sometimes, that just isn?t possible. Last week, we wrote about a finance executive who lost his job ? and, eventually, a multi-million dollar bonus package ? after mooning company executives.

The story prompted readers to share their own stories of ruining equipment, calling bosses names and otherwise making a dramatic exit from their soon-to-be former workplace. Given the circumstances, we couldn?t independently verify every detail of our readers? stories.

Clear, who lives in St. Louis and now works as a supervisor in a school writing lab, said she feels like she?s actually been very lucky in terms of the jobs and bosses that she?s had for most of her career. And although she recognizes that you have to make some compromises for work, she said there does come a point when you have to put your foot down.

?I don?t think anybody can allow themselves to be treated disrespectfully,? she said.

Of course, you also want to have a plan for paying your bills. When Clear started making plans for her dramatic exit, she said she also started documenting the behavior she?d endured from the boss. She said she was able to convince human resources to give her a severance despite the way that she quit, and she found a new job a couple months later.

It is actually possible to recover your career ? although perhaps not your job ? even after something as dramatic as mooning your boss, said Jodi R.R. Smith, who runs the etiquette consultancy Mannersmith.

?The first thing is to take a moment, calm down, pull up your pants and get your wits about you,? Smith said.

If you?ve got adrenaline pulsing through your system, calming down can take as long as 20 minutes. Then, it?s time to apologize ? and that doesn?t mean making excuses for your behavior.

?An apology does not contain a ?but? - no pun intended,? Smith said.

Chances are, you are still going to lose your job. But Smith said you still want to make sure that you are doing everything you can not to burn any more bridges on the way out.

You also need to remember that your peers, if not your boss, may end up serving as a reference. There?s another opportunity to remind your peers that you did other great things before your big outburst.

You don?t want to peer (to say), ?She was awesome! She totally told off the boss, she threw a stapler at his head and then she mooned him,?? Smith noted.

When Matt Herriot decided to quit a job he despised, he also knew he wanted to let the whole company know how he felt.

So one Monday morning, Herriot walked into the company?s weekly all staff meeting.

?I opened the door and I said, ?I?m not putting up with this anymore, I?m not doing this,?? Herriot recalled.

Then, with everyone staring at him, he put his laptop on his desk, explained the situation to another colleague who was standing there, and walked out.

Herriot, who is now 53 and lives in the Atlanta area, had once loved the company he ended up leaving so dramatically. He also had become very close with his co-workers, even attending the chief executive?s wedding.

But after first one and then another private equity firm bought out what had been a family-owned firm, he said things became toxic.

His new bosses were demeaning and aggressive, he said, even going so far as to interview new candidates for jobs in front of the people they would be replacing.

?It was just a horrid environment,? he said.

He left in 2005. It took about six weeks for him to find a consulting gig, and he said his former CEO didn?t speak to him for two years.

But gradually, things began to thaw. And in 2009, he said his former chief executive actually hired him again, to work at a different company. He?s been there ever since.

In retrospect, Herriot said he probably should have found a new job before quitting.? But he doesn?t regret the dramatic way he walked out.

??No, I don?t have any regrets because I don?t think I would have the job I?d have today if I didn?t take that stand,? he said.

Google's Larry Page and Apple CEO Tim Cook Meet to Discuss Patent Lawsuits

Reuters is reporting that Google and Apple have held secret, high-level discussions about the ongoing patent lawsuits between the two technology leaders.

In light of Apple?s recent patent lawsuit victory over Samsung, which included a judgment for damages of over $1 billion, it appears that Google is ready to talk and perhaps try to put an end to the ongoing legal battles between two of the most powerful corporations in the world. Reuters is reporting that Google?s Larry Page and Apple CEO Tim Cook have been meeting privately to discuss issues related to the ongoing working relationship between the two firms.

Prior to the onslaught of public and bitter patent lawsuits, Apple and Google seemed to have found a basis for co-existing in a way that allowed both companies to thrive. For example, Apple?s mobile operating system came with Google?s YouTube and Maps features as pre-installed applications. But with the launch of the iPhone 5 in just a few days, there will no longer be a Google footprint within the Apple operating system.

Google has also accused Apple of patent infringement, via a lawsuit filed by Motorola against the iPhone maker. What is beyond question at this point is that both Google and Apple have developed very popular and very functional mobile platforms with loyal followings. And given the growth in global sales of mobile devices ? for both Apple and Android systems ? there appears to be more than enough room for both the players to succeed in the game.

And now that the two sides are talking at the highest levels, perhaps there will be an opportunity for the two firms to work together. If such a collaboration were to ever materialize, consumers could stand to benefit significantly.

DougCo teacher union considers suing district for discrimination

The Douglas County School Board had every right to dissolve its ties with its teacher union, but it might face a lawsuit for discrimination, a union official said on Thursday.

Brenda Smith, president of the Douglas County Federation of Teachers, said although the district no longer recognizes the teacher union, it still works with the bus driver and mechanics union.

"They are doing this because we challenged them," Smith said. "They are now picking and choosing who they want to work with."

She said the union is reviewing its options, which include taking legal action.

In addition to voting to no longer bargain with the DCFT, the school board on Wednesday night decided to no longer withhold union dues from teachers' paychecks or pay union leaders' salaries with public funds.

The Amalgamated Transit Union has collective bargaining with the district and dues are still taken from paychecks.

School board president John Carson said the board is willing to bargain with the transit union because the two entities have a good working relationship, which does not exist with the teacher union.

"The ATU respects the policy role of the board and superintendent," Carson said.

The collective bargaining agreement for the Amalgamated Transit Union was finalized this summer, about the time the teachers' contract expired.

Colorado is a local control state, which means that it is the prerogative of school districts whether they want to work with a union. Deep tension has divided the board and teachers' union for some time, as the board has pushed education reform efforts that include voucher programs for private schools and pay-for-performance models.

Carson said unions are an outdated model, which the district no longer desires.

"This union had demoralized the district and spread disinformation. They are no longer required," he said.

Kerrie Dallman, president of the Colorado Education Association, said Douglas County is an outlier in the state and nation when it comes to its relationship with the teachers' union.

"We are seeing a good trend toward district-union collaboration," Dallman said. "This is the school board that was elected ? ultra conservative."

Other districts, such a Jefferson County, work with a union and feel the relationship is one that benefits education.

Cindy Stevenson, superintendent for Jeffco schools, said while it is not easy for the two groups to agree on everything, overall, a union is valuable.

"There were years when it wasn't so pleasant," Stevenson said. "But the fighting and disagreements puts stress and strain on students' education."

Smith said the once great relationship between the union and district has almost been erased in Douglas County.

"We used to have one of the best relationships in the country and were recognized for that by the U.S. Department of Education. But all that is gone with this board and this superintendent," she said.

Butterflies reveal Guantanamo biodiversity

Researchers from the Florida Museum of Natural History have documented 51 different butterfly species at the U.S. military base at Guantanamo Bay, showing that the area is an inadvertent wildlife refuge and biodiversity hotspot.

The base, which covers about 45 square miles (120 square kilometers) in the southeast corner of Cuba, was leased to the United States in 1903 and much of it remains undeveloped.

"Because it is a military base ? and this is true for many military bases, which typically have large areas of land ? people are not trampling, bulldozing or developing the land," Roger Portell, the Florida Museum's invertebrate paleontology collections manager, said in a statement. "So there is a large area of land in the southeast corner of the island that has basically been untouched for 100 years."

Researchers collected 1,100 specimens of 192 moth and 41 butterfly species, during a weeklong trip to the site in January. These specimens included the fulvous hairstreak butterfly (Electrostrymon angelia) and the invasive lime swallowtail (Papilio demoleus), along with the tropical buckeye (Junonia evarete zonalis).

Additional records from previously collected specimens brought the total number of butterfly species recorded at Guantanamo Bay up to 51.

The researchers said their study, which was published in the Bulletin of the Allyn Museum on Sept. 5, could inform continuing investigations into the biodiversity of the region.

"Biodiversity studies are extremely important, because they give us clues about where things were and how they evolved over time so we can better understand what may happen in the future," co-author Jacqueline Y. Miller, curator of Lepidoptera at the Florida Museum, said in a statement. "We're also looking at climate change over time, and butterflies are biological indicator species since they are associated with particular plants as caterpillars and often found in particular habitats."

Butterfly communities are often sensitive to larger changes in climate, from early snowmelts hitting Rocky Mountain populations of butterflies to species in Massachusetts heading north in response to warmer temperatures.
