I then had a choice to make: Either shiver in the car or risk getting stranded. I chose the former.

Of course I could have made the ride a more comfortable if I?d used the car?s little remote fob to preheat the interior while it was still plugged in. The trouble is that the little receiver, which has a tiny antenna like something from a 1970's-era sci-fi movie, isn?t at all clear. I thought I had engaged the pre-heat function, but when I got inside, the interior was the same 30 degrees as the ambient air.

Chalk that up to driver error. Errands completed, I pulled up to public charging station, conveniently located in downtown Ann Arbor, Michigan. In less than 12 hours, then, I experienced all the hazards of EVs. Once mundane tasks suddenly required planning and thought. And one slight bobble?like the charging inexplicably not working?could dash even the best laid plans. I?m not sure my feeble brain has the bandwidth left to compile the required permutations.

Of course, that?s the case with any electric vehicle, and I returned home thinking that the main objective of trailblazing electrics like the Nissan Leaf and this Mitsu is to get us used to the idea that an EV future?one that might never come to pass?is going to involve some compromises.

OECD pushes for $1.3 trillion eurozone crisis fund

BRUSSELS (AP) ? The 17 countries that use the euro should boost their crisis firewalls to at least ?1 trillion ($1.3 trillion) to help the struggling currency union return to growth, the head of the Organization for Economic Cooperation and Development said Tuesday.

Angel Gurria, the head of the Paris-based international development body, said current commitments to the rescue funds, which are limited to ?500 billion ($664 billion), are not enough to restore market confidence in the eurozone.

"A credible firewall will provide governments with the breathing space they need to focus on revitalizing Europe's economic growth and competitiveness," Gurria said in a statement linked to the release of the OECD's annual report on the eurozone economy. "Decisive action to restore confidence and support demand is needed now."

According to the report, which also spells out a raft of economic reforms for individual countries, vulnerable states may need more than ?1 trillion in aid over the coming two years.

Gurria said eurozone finance ministers should take a decision to boost their bailout funds at their meeting in Copenhagen later this week.

Germany, the bloc's largest economy, signaled on Monday that it would only support a temporary increase to around ?700 billion ($929 billion).

But that falls below the recommendation of the International Monetary Fund and the European Commission, the European Union's executive. It may also not be enough to convince other large non-euro economies, such as China and the U.S., to help in the beefing up of Europe's defenses by sending more money to the IMF.

International institutions argue that a big and credible bailout fund would restore confidence in vulnerable countries like Italy and Spain and prevent them from actually having to seek help.

Gurria said it could also allow weak economies to focus on kickstarting growth by reforming their economies.

"Europe is stalling," he said. "It needs to get out of first gear and make growth number one priority."

However, countries like Germany fear that easy access to financial support could stop countries from implementing reforms.

The NFL?s owners will begin to convene in Palm Beach on Sunday for the league?s annual meetings.

Hovering over the proceedings will be the decision to remove $46 million in total cap space from the Cowboys ($10 million) and Redskins ($36 million) over the next two seasons for their accounting practices during the uncapped year of 2010.

The league has admitted to the Redskins that the teams did nothing wrong and violated no rules.? Still, the NFL contends that treating the term ?uncapped year? too literally disrupted competitive balance ? even though the decision of multiple teams to grossly underspend in 2010 apparently gave rise to no such concerns.

The Redskins have been working to rectify the situation, privately communicating with the league and separately making plans for potential litigation.? But while no Redskins official has said anything publicly about the situation, Cowboys owner Jerry Jones opted on Friday to put the rest of the league on notice that he won?t take this one lying down.

And he shouldn?t.

As we understand it, the teams will try at the league meetings to lobby other owners, making the case for some adjustment to the punishment sans crime.? If, in the end, the Redskins and Cowboys get nowhere, litigation could occur.

?[T]here is no joy in Mudville, having to team up with the Redskins on a point with the league,? Jones told the Dallas Morning News. ?They?re competitors, not cohorts.? It just shows you, independent of that, some of the issues we have with this cap-space issue.? Sometimes you can have strange bedfellows and this is one of them.?

The situation has several curiosities, which include a decision by the league to offer to the NFLPA the Redskins/Cowboys cap penalties in exchange for an increase in total cap space for 2012, and the absence of an ownership vote on the measure.? As one league source previously explained it to PFT, the mere act of conducting a vote would have given Jones and Redskins owner Dan Snyder an opportunity to attempt to secure the support of seven other teams, which then would have prevented the NFL from securing the necessary 24 votes to push the measure through.? (It also would have forced those teams that wanted to take cap space from the Cowboys and Redskins to go on record with a vote in favor of the move.)

In our view, the league needs to fix this before it spirals out of control.? It?s now obvious that the NFL was engaged in collusion in the uncapped year, trying to keep more money in the owners? pocket and less in the players? as a possible year without football loomed.? Still, forcing the Redskins and Cowboys to reduce to writing an allegation that the NFL and its teams tried to rein in spending and is now punishing the two that refused to go along with the illegal plan won?t be good for business.

Indeed, it won?t be good for anybody.

Oscar winner Octavia Spencer honored by hometown

MONTGOMERY, Ala. (AP) ? Oscar-winning actress Octavia Spencer is being honored at the Alabama Statehouse, where about 400 people turned out to welcome her.

Spencer won this year's best supporting actress Oscar for her performance as a maid in "The Help."

She rode up to the Statehouse in a pink limousine for the Wednesday ceremony. As she stepped out, she was serenaded by the band from her alma mater, Jefferson Davis High School.

A Montgomery native, Spencer told the crowd that she would do whatever she could to see that more movies are made in Alabama. She also cautioned young people in the audience to think twice before heading to Hollywood to become a movie star.

Spencer was then honored by a joint session of the Legislature.

In ?Oh, Really?? the Biederman Blog?s editors ? voracious consumers of all matters pop culture ? cast a curious, skeptical, fun and smart end-of-the-week eye on popular productions, sharing their keen observations about legal matters these raise.

Here?s the power of Hollywood: It can take a topic that inspires more than its share of dread for more than a few law students ? estate planning ? ane make it a powerful undercurrent of an Oscar-winning movie. That?s what occurs in The Descendants, a movie that won the Oscar for best adapted screenplay, and was nominated for Oscars in four other categories, including best picture, best actor (George Cloney) and best director (Alexander Payne). The movie, which is just out on DVD and Blue-Ray, is based on the novel by Kaui Hart Hemmings. Though its plot takes many twists, the heart of the story turns on what happens to valuable land on Kauai, left to Clooney?s character in a trust by a wealthy banker and a Hawaiian princess.? The trust is about to expire and Clooney, a property attorney, must decide whether to sell the property to a developer, enriching himself and his greedy cousins.

To most viewers, the film?s depiction of estate planning provides little more than a gloss. But in this Oscar-winning production, the legal issues were thoroughly developed and fact-checked. Director Payne consulted with Randall Roth, a University of Hawaii School of Law professor and nationally known trusts and estates expert. To make the work accessible, the film has tweaks and ?widening? of legal issues to fill in the viewer?s gaps. Still, among the topics it touches that will be familiar to legal eagles are:

The Rule Against Perpetuities. This aspect of estate law, abhorred by many law students but still applicable in many states, makes its way into the movie, probably giving most attorneys flashbacks to property law class.? This rule prevents a trust from lasting indefinitely and sets a maximum term. It traditionally was measured by ?lives in being plus 21 years,? which meant that most trusts would last around 100 years. To make the facts of the book?s plot work into the movie?s timing, the number is rounded up (incorrectly) to 150 years.

Joint ownership issues. The form of joint ownership presented in The Descendants is known as a tenancy-in-common, though this term is not explicitly used. Clooney and his siblings all own their own share of the pricey property, also known as an undivided interest. As the plot shows, this arrangement easily may lead to family squabbling, since even a party owning a small percentage can prevent the sale or development of a property.

Trustee?s Duties.?Under common law, trustees carry fiduciary duties ? either express or implied ? to the beneficiary of the trust. The most important of these are:? (1) to manage the trust in accordance with the instructions of the settlor; (2) a duty of good faith, which requires the trustee to put the best interests of the trust ahead of his own; (3) a duty of prudence, which requires the trustee to manage the trust property with the same degree of skill that a prudent person would exercise in his or her own affairs; and (4) a duty to preserve and protect the trust assets, or trust corpus, to satisfy both present and future claims against the trust.

An important legal concern in all trusts, as The Descendants illustrates, is determining what the person who set up the trust (the settlor) would want to do with the property, even several years death. Clooney struggles with this issue as he stares at portraits of his long-dead ancestors, who have kept the land untouched for decades. Since Clooney is the only named trustee, he wields the power and the obligation to execute the trust to the settlor?s true intent.

Whether trustees are friends, family members or professionals, they owe a duty not only to settlor but also to the the beneficiaries: This includes a fiduciary duty always to act in their best interests and to avoid conflicts of interest. Clooney may breach his fiduciary duty, as he turns down an attractive offer from a real estate developer, who also happens to have had an affair with his comatose wife. When Clooney refuses to sign the deal, he tells his cousin, ?You can sue me.? Likely, this statement was made because attorney Clooney recognizes the legal implications of his decision. Even if sued by his cousin, in real life, Clooney could offer the defense that his ancestors would have wanted to keep the land pristine.

Roberts Signs Contract to Remain EFM for the Detroit Public Schools

CBS Detroit reported that the emergency financial manager for the Detroit Public Schools, Roy Roberts, announced on Monday, March 12, that he would be extending his stay another year. Roberts was due to vacate his post in May.

Roberts made his announcement in an exclusive interview with WWJ Newsradio on Monday morning. He said that leaving in May could have put the work that he has done with the DPS "in jeopardy."

Here are some of the details regarding Roberts' decision to stay on another year with the DPS, as well as decisions made in his first year in office.

- The DPS is Michigan's largest school system by far, with 66,000 students, 130 schools, and an annual budget of more than $1 billion.

- Roberts' new contract has the EFM staying put until May 16, 2013, according to the Detroit News. He will be paid the same $250,000 salary that he received through the first contract.

- Roberts has repeatedly said that he believes that under his guidance that the DPS system has been able to make substantial gains, including reducing its deficit from $347 million to $83.6 million in under a year.

- Roberts is actually the second EFM to run the DPS. Former Gov. Jennifer Granholm had appointed Robert Bobb to oversee the DPS in 2009. Gov. Rick Snyder replaced Bobb with Roberts in May of last year.

- Roberts has eliminated 400 positions in the DPS since taking office, according to the Huffington Post.

- Critics have also pointed out that his budget deficit reduction plan largely relied on what are referred to as "long-term" bonds. Which means that when they mature in 10 years, the district will be $500 million in debt once again.

- He has also cut DPS employee pay by 10 percent across the board and has instituted a requirement that they pay 20 percent of their own health care costs.

- In addition to serving as the EFM for the DPS, Roberts will have a place on the board of the newly instituted Education Achievement System. The EAS is the brainchild of Gov. Snyder and will essentially create a new state-led school district by removing failing schools from their home district to be part of the EAS.

- Roberts' tenure has been the focus of several lawsuits, including one that is currently before the Michigan Supreme Court. A related ballot initiative aimed at striking down the state's emergency financial manager law in November has put Roberts' job in question.

- For his part, Roberts says he is focused on "getting the job done," according to the Associated Press.

In 2004, I started wearing a Livestrong bracelet every day. ?I turned to the organization website after Granny was diagnosed with liver cancer. ?The one piece of advice that struck me was, ?allow yourself to feel.? ?And I make the attempt to do that.

On March 2, I lost a friend of mine even though I did not find out until late night March 4th. ?All day on the 2nd I felt as if something big happened and I missed it. ?I even checked Facebook and saw nothing. ?I put that feeling aside and went in to work for my closing shift. ?I thought nothing of it until a mutual friend sent me the funeral information Sunday night, which was when I found out. ?And that would explain that feeling I had Friday. ?I was shocked, upset, and horrified at the same time. ?She was 3 years younger than me. ?I was friends with her husband as well. ?We all worked together for a number of years. ?Her husband and I worked in the same program my last year with the agency. ?We spent a lot of time trash talking about football (my alma mater went to the Sugar Bowl that year). ?We trash talked in the kitchen, too. ?Who had better skills. ?The kids we worked with were fortunate to have us both teaching them kitchen skills. ?Erin and her husband would have celebrated their 4th wedding anniversary this May.

I was lucky to have had the Monday and Tuesday off after hearing about Erin?s death. ?I tried working out a way to reschedule my monthly ACE treatment to drive down to Louisville for the funeral. ?In the end it came down to my state of mind after a funeral. ?There was no way I would be able to drive back two hours at night after spending time grieving with friends. ?I stayed home and grieved on my own. ?Those two days I allowed myself to feel. ?Everything I had planned to do those two days other than grocery shopping, fixing dinner, and my doctor?s appointment was set aside. ?Cleaning and experimenting in the kitchen could wait. ?Feeling my heart and soul was more important. ?I allowed myself to cry when I felt the need to cry. ?I let the memories come and keep me company. ?I did whatever I felt I wanted to do whether it was read, watch TV, listen to music, etc.

By the time I returned to work on Wednesday, I was feeling marginally better. ?Still sad and in shock, but more able to handle what life would hand me at work. I kept allowing myself to feel and reminded myself that I needed to keep living as strong as I did after Lelang (my paternal great-grandmother), Granny, and Papa passed in 2004. ?I kept hearing in my head the priest at my late sensei?s funeral saying, ?This sucks? over and over again telling myself that it?s okay to think that. Because it does. ?It sucks.

Yesterday, I worked the ad set so I was in super early and then got to leave at 10am. ?When I got home, Chaz was still sleeping so I let him sleep while I iced my feet and watched the last episode of Game of Thrones, season 1. ?Chaz calls it my new addiction since I?ve read 3 of the books so far. ?When he finally got up and took a shower, we went out to lunch and then to a new Japanese market in our neighborhood. ?It was perfect because I just wanted to be out doing something and enjoying the beautiful day we were having. ?I was also experiencing some joy returning to me that day. ?We were in the parking lot of Red Robin after lunch and I just stood there taking in the sunshine with my face upturned and eyes closed as Chaz smoked his cigarette. I was like a little kid in the market because I was finding things I had not seen in a while. Things the larger Asian supermarket down the street didn?t have.

While I was trying to show Chaz the Kikkoman gluten-free shoyu (which turns out, I picked up the wrong bottle), I heard my phone quietly ringing. ?It was Auntie A. As soon as I answered, she hung up. ?But she called Chaz?s phone next. ?When she said, ?I have some bad news? in between her own sniffles, I knew.

Grandma passed away sometime Saturday night/Sunday morning. ?Like Lelang, Granny, Papa, and Grandpa, she went peacefully.

I had to leave the store while talking to my auntie. ?Standing in the middle of an aisle is no place to be blubbering. ?The rest of the day passed in a bit of a blur. ?I was exhausted from working Saturday night and going back in hella early Sunday morning. ?I got about 4 hours of sleep, so I was fairly sleep deprived as well. ?Chaz attempted to try to make me nap. ?I knew it was futile and my brain would only keep racing. ?Instead, I just allowed myself to feel again and let the memories come as they would. ?I trade memories with cousins, aunties, and uncles all afternoon/night on Facebook. ?We all gave each other virtual hugs wishing we could all hug each other for real.

It?s one thing to lose a friend. ?It?s another thing to lose someone who was woven into part of your being.

When you ask me about my family, my frame of reference is a bit different so my answer is going to be about my entire family. ?Family is not just my nuclear family. It?s my extended family. ?It took a village to raise me. ?Both sets of my grandparents had as much to do with my growing up as my parents did, but without all the rights of a parent. ?I learned as much from my grandparents and Lelang as I did from my mother and father ?I reminded my cousins today that we were lucky to have had her in our life as much as she was since so many kids either barely get to see their grandparents growing up or never even know them at all.

When I would spend time with my grandparents on Moloka`i as a child, my aunties and uncles (not much older than I am) would inevitably treat me like the youngest sister. ?When they would tease me or give me a hard time, I would always go running to Grandma. ?And Grandma, ever the protector, would give them scoldings. ?She always looked out for me. ?She would make my youngest uncle sit with me at the table as I finished my meals, because I was always the last one to finish and she didn?t want me to be alone at the table. ?In college, every time I came home to visit, she made my favorite dish of hers. ?Clams boiled with onions and tomato served over rice. ?She eventually taught me to make it myself.

So many memories. ?I?m letting them visit and I?m feeling. ?I miss her terribly and wished we would have been able to see her back in November when we were home. I?m waiting to hear about her arrangements so I can make my arrangements to go home. ?With Lelang and Grandpa already gone, the house will feel empty without her presence. ?Going home to Moloka`i is never going to be the same again even though I still have many family who live there. ?Both of my grandparent?s homes to me were the homes I knew. ?My parents moved us around a lot so always being able to go back to the same homes to see my grandparents with so many memories attached to them was a blessing.

With all this going on, I get tempted to fall into my natural role of detaching myself and plowing ahead full steam. ?I also get tempted to fall into unhealthy coping skills. ?The night I found out about Erin, my first instinct was to get drunk. ?I knew better and didn?t. ?I did allow myself a little junk food through the week and made sure not to overdo it. ?I did a little retail therapy. ?A few more books added to my ?to read? pile and The Game of Thrones on BluRay that I watched throughout the week. ?No massive purchases.

While I know I need to live strong. ?Now is the time to allow the vulnerability to work. ?I remember how some friends at church back in my college days commented on how strong I am. ?I am strong because I allow myself to be weak. ?To give in and admit I?m not strong all the time and that I need God to take control. ?The best coping skill has been allowing the vulnerability and the feelings. ?Allowing me to be me while I grieve and not take a detached clinical view of the process.

I will be okay. ?Just not today. ?Maybe not tomorrow. ?But one day.

6 execs charged in Olympus loss coverup scandal

TOKYO (AP) ? Japanese prosecutors formally charged Olympus Corp.'s former chairman and five other people Wednesday in a high-profile scandal involving a cover-up of massive investment losses at the company.

Tokyo prosecutors said in a statement that they formally pressed charges against Tsuyoshi Kikukawa, two other former executives at the Tokyo based medical equipment maker, along with three other men from consulting companies who collaborated in the scandal.

The six men were arrested in mid-February on suspicion that they falsified the company's financial statements from 2006 to 2007.

Prosecutors started a fresh investigation of the four former Olympus employees Wednesday over alleged additional falsification from 2008 to 2010.

Olympus has said it hid 117.7 billion yen ($1.5 billion) in investment losses dating to the 1990s.

The scandal surfaced late last year when then-President Michael Woodford raised questions about payments for financial advice and acquisitions of companies that were not related to Olympus' mainstay operations.

Olympus initially denied any wrongdoing but later acknowledged the hiding of investment losses.

The company late last month renewed the board and picked new leadership.

Hiroyuki Sasa, 56, with experience in the company's key medical equipment business, would become president, with Yasuyuki Kimoto, 63, former executive at Sumitomo Mitsui Banking Corp., which is Olympus' main bank, becoming chairman. The changes will become official at shareholders' meeting in April.

Kikukawa resigned from all posts at Olympus last year. The company is suing him and 18 other former and current executives for damages in the cover-up.

The scheme came to light after Woodford blew the whistle and has raised questions about corporate governance in Japan and whether major companies are meeting global standards.

Olympus's internal investigation found that some executives were involved in the deception.

Woodford was fired in October after raising his concerns. He recently gave up his comeback attempt after failing to win support from major investors including Japanese megabanks.

Olympus barely met its mid-December deadline to avoid being removed from the Tokyo Stock Exchange by filing corrected earnings for the April-September first half and for the past five fiscal years.
