Windows Marketplace reaches “important milestone” of 50,000 published apps

Microsoft's Windows Marketplace has reached 50,000 published applications, which has been called an "important milestone" by some, while others question any impact it may have on device sales.

The latest statistics, gathered by All About Windows Phone, show that Microsoft?s mobile application store, Windows Marketplace, has reached a total of 50,000 published apps. The store?s growth has been accelerating since the platform?s launch earlier in the year, increasing by 20,000 since the end of August, and making the jump from 40,000 to 50,000 apps in just 40 days.

Four categories account for 57% of the store?s content with the biggest being ?entertainment?, but perhaps surprisingly it?s ?books and reference? next, beating ?games? down into third place. In fourth place it?s ?tools and productivity?. These four are separated by less than 1,000 apps, so it could all change in the future.

The split between paid and free apps is similar to the Android Marketplace and the iTunes App Store, with 58% of WP7 apps available for free, and 29% being paid apps. The final 14% contains free trial apps.

Windows Marketplace continues to grow at an estimated rate of 265 apps per day, however in terms of sheer numbers of available apps, Microsoft is still a way behind Android and iOS.

On a similar note a former Microsoft executive, Charlie Kindel, has commented this week on why he thinks Windows Phone is still lagging behind the competition. Calling Windows Phone a ?superior product?, he blames network providers and device manufacturers for not pushing it in the same way they do Android.

End users, he says, ?just do what they?re told by advertisers and sales people,? but because networks chose the easy route of backing Android in their ads, WP7 hasn?t had the right level of exposure yet.

He also appeared to say that applications and developers are irrelevant to a platform?s success, but later clarified the statement by saying they were still important, just not to his argument.

Many disagree, with an analyst for Current Analysis summing up the general consensus by saying the 50,000 app barrier is ?an important milestone,? and that a large app store could help drive sales forward.

Family Mourns Combat Veteran Who Died In Union Co. Plane Crash

A family was mourning the death of a man on Friday after he died in a plane crash.

Lt. Col. Mike Lakin's single-engine Super Decathlon plane crashed Thursday while he was recertifying for low-level aerobatics. Several witnesses and emergency crews tried to save Lakin, but he died after being transported to a hospital, 10TV News reported.

Lakin, 42, who was from Charleston, W. Va., was the son of a World War II veteran and received his pilot's license when he was in high school.

After serving in the Marines and the Navy, Lakin returned to West Virginia, where he joined the West Virginia Air National Guard and spent more than a year on combat missions in Iraq and Afghanistan, 10TV News reported.

Lakin's associate pastor said Lakin?s life was all about flight, faith and family.

"I think he liked to fly," Associate Pastor Shauna Hyde said. "He offered folks flying trips constantly."

Lakin was also a devoted father to his 8-year-old daughter, Hyde said.

"He wanted her to have the memory that he loved her," Hyde said. "He loved God so much that he made it a priority in his life."

Lakin's plane crashed while performing a low-level snap and roll, just moments after taking off.

Hyde said that his death sends a message about the precious gift of life.

"Even if you've lost someone, there's someone else who loves you and has your love," Hyde said. "That is the great gift."

Justin Bieber Debuts New Song, 'Be Alright'

Much like Lady Gaga, Justin Bieber is treating his crew of Beliebers to some new music right in time for the Christmas holiday. On Wednesday night, the pop superstar debuted a new track called "Be Alright" to a jam-packed crowd during his Toronto-based TV concert special, "Justin Bieber: Home for the Holidays," which airs Thursday night (December 22) on MuchMusic and CTV.

"You might hear this on my next album, you might not, but it's a song I'm working on. I still haven't really finished it," Bieber told the screaming crowd, before unveiling the acoustic tune. "Basically, the concept is: Even though when times get hard with your girlfriend or boyfriend, when times get hard, you gotta just let them know that in the end, everything's gonna be alright."

Sitting beside his guitarist, MTV News' #5 Newsmaker of 2011 crooned to the slow jam as the audience clapped their way through his performance, and later on, helped the star sing along to the simple hook. "Across the ocean, across the sea/ Starting to forget the way you look at me now/ Over the ocean and across the sky/ Starting to forget the way you look in my eyes," he sang.

After the holiday special, the teen singer took to Twitter to share his thoughts on the memorable evening, writing, "Tonight was special. No rules. Music, family, friends, fans, charity, and music. Thank you. #HomeForTheHolidays."

"Be Alright" is just a taste of what may come from the singer's next album release. MTV News recently spoke with JB's longtime vocal producer, Kuk Harrell, who discussed his thoughts about the pop star's transition into adulthood.

"The only conversation we've had about Justin's album that we're about to do is it's really important that it's the proper transition because we've seen him [with] 'Baby,' now we're watching him grow up," Harrell told us. "And we can't just throw him into the adult game right away. It has to be the proper transition. There's a record in between."

WPP Ups Asian Holdings, Buys Stake In Chinese Agency

WPP has gone on a holiday shopping spree acquiring or investing in six agencies and two technology firms in the last month. The latest buy: the purchase of a 49% stake in Chinese ad firm Nanjing Yindu, through WPP?s global agency network Ogilvy & Mather.?

Commenting on the investment, the holding company stated: ?This move expands Ogilvy's reach into the important Yangtze River Delta, a crucial region that encompasses not only Jiangsu province, which has the second-highest GDP [gross domestic product] of all Chinese provinces, but also Anhui and Zhejiang provinces.? WPP added that the investment ?underlines WPP's regional approach in China, not confined to the coastal region.?

The agency?s services include strategic planning, advertising, branding and corporate identity, print and media production and media buying. It employs 250 people and clients include Chinese brands such as Jiangsu Mobile, Heilan Home, Jiangsu Yanghe Brewery, Nanjing Iveco, MoonHare, Simcere, Longliqi and China Construction Bank.

In fact, most of the agencies acquired during the spree are based in Asia. (The exception was the previously reported Washington, D.C.-based Glover Park PR Group). ?

WPP has identified the Asia Pacific region as a key target of opportunity, and its businesses there currently generate revenues of more than $4 billion and employ approximately 42,000 people.?

Last week, through digital shop VML, WPP bought a majority stake in full-service digital-marketing agency Qais Consulting in Singapore. The shop will rebrand as VML Qais and operate as part of Y&R Asia. Qais, which also has a presence in Mumbai, India, has a client roster that includes Standard Chartered Bank, Sony Electronics, Sony Pictures, Hilton Hotels, Mahindra & Mahindra, ICICI Bank, Tata Motors and the Singapore Ministry of Defence.?

Also last week, WPP bought majority stakes in two Asian PR firms, one through Ogilvy PR and the other via Cohn & Wolfe. Ogilvy bought Hong Kong-based Mind Resource Healthcare Consulting, while Cohn Wolfe acquired digital and general interest PR firm XPR, based in Singapore. Two weeks earlier, Cohn Wolfe bought a majority interest in Impactasia, with offices throughout Greater China.

On the technology front, WPP?s 24/7 Real Media, in a bid to bolster its streaming capabilities acquired the assets of Panache, the video advertising software and services company.? The Panache assets will be incorporated into 24/7?s Open AdStream advertising management platform, WPP said.

The holding also took a minority stake in London-based mobile tech firm Lumi Technologies, which has a platform that creates real-time event apps for mobile devices. Clients include EMI, Endemol and Channel 4 in the UK, ABC in the US and Mediaset and YLE in Europe.

Whether the buying spree was the result of coincidently timed opportunities, a year-end using up of the M&A budget or some other reason wasn?t clear. A holding company rep wasn?t available for comment at press time.

Calif woman charged in terrorist funding case (AP)

LOS ANGELES ? A California woman was indicted on federal charges alleging she sent money to Pakistan to help fund terrorist attacks against U.S. military personnel, authorities said.

Oytun Ayse Mihalik, 39, of La Palma, was named Wednesday in a four-count indictment. She faces three counts of providing material support to terrorists and one count of making a false statement. Mihalik could face up to 53 years in prison if convicted of all charges.

Mihalik funneled about $2,000 to a person in Pakistan over a three-week period beginning late last year, knowing the money would be used to prepare for and carry out attacks against the U.S. military and others overseas, federal prosecutors said.

Mihalik, who worked as a pharmacist, has been in federal custody since she was arrested in August after she attempted to board a flight to Turkey, her native country.

She previously pleaded not guilty to the false statement charge.

Mihalik lied to federal agents during an interview at Los Angeles International Airport following a six-month trip to Turkey by telling them she never used an alias to wire money overseas and she had only sent funds once, authorities said.

She told investigators the money was meant for a family friend who was having financial problems, according to an affidavit. Authorities wouldn't elaborate about how they know the money Mihalik wired overseas was going to be used for terrorist attacks.

However, court documents reveal Mihalik's arrest is "related to national security investigations in other areas of the United States." As of August, Mihalik had been cooperating with investigators, records show.

"The charges are based on the defendant's intent to cause harm to U.S. military personnel," said Thom Mrozek, a spokesman for the U.S. attorney's office in Los Angeles. "We have not alleged any attacks that may have resulted from the funding because the legal issue is the defendant's intent as to what the money would be used for."

Defense attorney Alan Eisner said no new evidence has been offered up by prosecutors since his client's arrest four months ago, and the money sent overseas was donated to charity.

"The evidence will show she's not funding a terrorist organization," Eisner said.

A trial on the false statement charge was set for February. Mihalik will be arraigned on the new charges at a later date.

Hard Enough to Live With Unemployment Insurance, Let Alone ...

Terry Miale, a communications systems engineer, lost nearly everything when she lost her job.

My whole life is gone. My retirement is gone. My house is gone. For a period of time, I lost my mental health because I went into a deep depression.

Even though she worked 30 years in her field, it took Miale four years to get?re-employed.?So Miale can?t understand why Republican leaders in?Congress just won?t extend unemployment insurance (UI) to long-term unemployed workers who can?t find jobs in an economy in which there are more than four workers for every one job.

When I needed? unemployment benefits, they were there. I really?think that it isn?t fair to pull a lifeline out from under people that are just now having to collect unemployment benefits. It?s hard enough to live on unemployment benefits, let alone live with none.

Unless UI is extended this month, 2 million jobless people will lose their lifeline.?Those in Congress blocking the UI extension should be made to feel what it?s like to be unemployed.

Sign a petition to Congress demanding it act now to extend the emergency UI benefits program.

Abuse lawsuit against Rumsfeld, Gates tossed out (AP)

McLEAN, Va. ? A federal judge has dismissed a lawsuit filed against former defense secretaries Donald Rumsfeld and Robert Gates by 28 military members and veterans who said they were victims of sexual assault.

The suit, filed earlier this year in U.S. District Court in Alexandria, alleged Rumsfeld and Gates fostered a culture that allowed rapists to thrive and punished assault victims for filing complaints against their attackers.

But in a ruling issued Friday, Judge Liam O'Grady said the judiciary should not intervene in matters involving military discipline and dismissed the case, even though he called the victims' allegations troubling.

The plaintiffs' attorney, Susan Burke, did not immediately respond to an e-mail Wednesday asking whether she would appeal.

In one example, an Army Reservist said two male colleagues raped her in Iraq and videotaped the attack. She complained to authorities but says charges weren't filed because the commander did not think she acted like a rape victim.

One of the plaintiffs, Rebekah Havrilla of West Columbia, S.C., said in response to the ruling, "It is now practically impossible to get the judicial system to provide any remedy for those that have been victimized by the inadequate military system."

Havrilla, an Army sergeant from 2004 to 2009, was deployed to Afghanistan. In the lawsuit, she alleged that a colleague raped her and photographed the attack. When she sought counsel from the military chaplain, he told her it must have been God's will for her to be raped and recommended more frequent church attendance. The attack occurred at a time when she was subjected to routine harassment from her supervisor, who slapped her on the bottom and kissed and bit her on the back of the neck, according to the suit.

Havrilla is now a staff member for the Service Women's Action Network, which was founded in 2007 by female veterans to advocate for victims of rape, sexual assault and sexual harassment in the military. Although The Associated Press normally does not identify the victims of sexual assault, Havrilla agreed to allow her name to be used.

Greg Jacob, the network's policy director, called the judge's ruling unacceptable and "a tragic comment on the issue of military sexual assault."

Statistics collected by the Pentagon show more than 3,000 reports of sexual abuse in the military in fiscal year 2010, but only 529 went to trial. The Pentagon estimates that the vast majority of assaults go unreported altogether.

Judge rejects exam request in White House case (AP)

WASHINGTON ? A federal judge on Friday denied a government request for a more thorough and extensive psychiatric evaluation of a man accused of firing shots at the White House in what prosecutors say was an attempt to assassinate President Barack Obama.

The mental state of Oscar Ramiro Ortega-Hernandez, who prosecutors say harbored fantasies of killing the president, has been a critical issue since his arrest last month. A preliminary psychiatric screening already found him competent to stand trial. Prosecutors want another evaluation that conclusively puts to rest any concerns about Ortega's ability to understand the charges against him. A comprehensive evaluation would also strengthen the government's case against any later attempt by defense lawyers to use a mental health defense.

U.S. Magistrate Judge John Facciola said there was currently no evidence suggesting that Ortega is incompetent to stand trial. But he said prosecutors can renew their request as the case moves forward if they believe Ortega's mental health is deteriorating.

"A delusional system does not in and of itself compel the conclusion of a defendant's incompetence," he said.

Federal prosecutors say Ortega bought a gun and more than 1,200 rounds of ammunition in Idaho, where he lived, practiced firing it for months and then drove east with the goal of assassinating Obama. They say Ortega referred to himself as the "modern-day Jesus Christ," perceived Obama to be the antichrist and considers marijuana to be the answer to world peace. He opened fire and sped away, prosecutors say, before being arrested five days later at a Pennsylvania hotel.

Authorities located at least five bullet impact points on the south side of the White House or above the second story, court papers say, and two bullets were recovered from the White House ? including one from a window frame on the Truman Balcony. Obama and his wife, Michelle, were out of town at the time.

Elizabeth Teegarden, a clinical psychologist who interviewed Ortega for 50 minutes after his arrest, said Ortega denied delusional thinking, phobias and having aspirations to harm himself or others. When she asked him about statements in the criminal complaint that he had told others that he wanted to kill the president, he either denied the statements or refused to talk about them.

Ortega's public defender, David Bos, said Ortega not only is able to help in his defense but also "understands highly technical principles."

Gaddafi's death may be war crime: ICC prosecutor (Reuters)

(Reuters) ? The death of former Libyan leader Muammar Gaddafi, who was captured and killed by rebels in October, may have been a war crime, the chief prosecutor of the International Criminal Court said on Thursday.

"I think the way in which Mr Gaddafi was killed creates suspicions of ... war crimes," ICC prosecutor Luis Moreno-Ocampo told reporters.

"I think that's a very important issue," he said. "We are raising this concern to the national authorities and they are preparing a plan to have a comprehensive strategy to investigate all these crimes."

Under pressure from Western allies, Libya's National Transitional Council has promised to investigate how Gaddafi and his son Mo'tassim were killed.

Mobile phone footage showed both alive after their capture. The former Libyan leader was seen being mocked, beaten and abused before he died, in what NTC officials said was crossfire.

The U.N. Security Council referred Gaddafi's crackdown on pro-democracy demonstrators to the ICC in February and authorized military intervention to protect civilians in March. The ICC indicted Gaddafi, his son Saif al-Islam and the former intelligence chief for war crimes.

Saif al-Islam is now in the custody of the Libyan authorities who have said they plan to try in him in Libya instead of handing him over to The Hague-based ICC. Moreno-Ocampo has said this was possible.

Moreno-Ocampo has also said he was investigating allegations that the anti-Gaddafi forces and NATO were also guilty of war crimes during the civil war.

New interface could help Facebook members limit security leaks

ScienceDaily (Dec. 5, 2011) ? A sign-up interface created by Penn State researchers for Facebook apps could help members prevent personal information -- and their friends' information -- from leaking out through third-party games and apps to hackers and identity thieves.

When Facebook members sign up for apps developed by third-party companies, they may not know that these apps are sometimes overriding their global settings on privacy preferences and information sharing, said Heng Xu, assistant professor of information sciences and technology.

"One illusion is that people think that they have set global privacy settings, so it's secure," said Xu. "But the broken element is in the third-party applications that people use to play games and interact in different ways with each other on Facebook."

Members who sign up for an app must agree to new terms of information disclosure that are often different from their main Facebook privacy settings when they sign up for an app, Xu said. The sign-up screen currently is a general agreement that shows information third-party developers are requesting. If the member does not agree, the member cannot use the app.

The screen designed by the researchers allows members to decide what types of information they are comfortable sharing and with whom they want to share it. Xu, who worked with Na Wang, doctoral candidate, and Jens Grossklags, assistant professor, both of information sciences and technology, designed two alternative third-party privacy agreement screens to clearly show members what data and privacy details they agree to share with the developer.

The researchers, who presented their findings on Dec. 4 at the Association for Computer Machinery Symposium on Computer Human Interaction for Management of Information Technology in Boston, asked a group of Facebook members to try two app sign-up page designs, a single-color scheme and one that used three colors -- green, yellow and red -- to designate critical information. The design also features three boxes to offer members the option to share their app activity history with all the members of their network, just specific people, or keep all of the information private.

Of the 11 participants, all said that improving the security and privacy of the sign-up pages is important. Six of the testers preferred the multiple-colored scheme to the monochromatic version.

Privacy settings allow members to determine how much information the member wants to display or share with their members of their network and Facebook. This data can include birthdate, hometown and current city, as well as pictures the members uploaded to their pages.

Members may not consider data such as hometown or birthdates vital information, but Xu said hackers can use such information to guess social security numbers.

Xu said people may not even know that they may expose their friends' personal data if they use apps. A calendar app, for example, could allow developers to access the member's birthdate, as well as the birthdate of friends who are part of the member's network.

"Some people may know that they are allowing these companies to access their data," Xu said. "However, they might not know that their info will be leaked through their friends, use of games and other applications on Facebook."

According to Xu, many Facebook app developers try to make money from their games and tools by selling or sharing the data with advertisers and other companies.

"The only way to find out how the information is going to be used is to go to each app's website and review the terms of use," Xu said. "And many people won't do that."

The National Science Foundation supported their work.

Once-conjoined toddlers leave Va. hospital (AP)

RICHMOND, Va. ? Two formerly conjoined toddlers from the Dominican Republic have left a Richmond hospital after recovering from separation surgery, and doctors predict they'll be ready to go home by Christmas.

Maria and Teresa Tapia left Children's Hospital of Richmond at Virginia Commonwealth University on Friday. At a news conference before their departure, the girls clapped and waved and one kissed the lead doctor on their surgical team, Dr. David Lanning.

"I thank God and everyone who made this possible," the girls' mother, Lisandra Sanatis, said through a translator.

The 20-month-old twins were attached at the lower chest and underwent complicated, nearly daylong surgery on Nov. 7. In a series of procedures, the surgical team divided the twins' liver, pancreas and other shared organ systems and reconstructed their abdominal walls.

While they're getting accustomed to exploring their surroundings separately, they still stay near each other and hold hands when they walk.

Lanning said Friday that both children have been recovering well, and doctors don't expect them to require any long-term medical treatment, except possible minor surgery to construct belly buttons.

"Overall, I don't think we could have asked for a better outcome," he said at Friday's news conference.

They'll lead healthy, long lives, with the ability to "be together but make independent decisions."

Maria, the smaller of the two, weighs about 19 pounds, and Teresa weighs about 26 pounds. Lanning expects the disparity in their weight, caused by the configuration of their small intestines and blood flow from the liver, to gradually even out.

Maria's pancreas is slow to produce digestive enzymes, but she is taking replacement enzymes, and doctors are monitoring her colon function. Teresa is undergoing treatment on the incision where the girls were separated, Lanning said.

Doctors, nurses, volunteers and others who cared for them gave the girls and their mother and aunt a warm send-off from the hospital Friday afternoon. Lanning pushed a new double stroller to the van that took the family to a nearby residence for patients and their families.

The girls will stay in Richmond for follow-up medical visits and outpatient therapy to continue working on walking and other motor skills now that they're no longer attached. Lanning said they're on track to return to their native country by Christmas.

After being in Richmond for several months now, Sanatis said she and her daughters have grown fond of everyone they've met. But they're more than ready to go home and reunite with the twins' father and three other siblings.

The twins have become celebrities in the Dominican Republic, with supporters including the country's first lady, Margarita Cedeno de Fernandez, who visited Richmond on the day of the surgery.

The World Pediatric Project, a nonprofit surgical-care provider for children in Central America and the Caribbean, sponsored the toddlers' medical care, along with the family's stay in the United States. Lanning has been a surgical volunteer with the group for several years.

About a half-dozen separation surgeries are done in the U.S. annually, and maybe double that number worldwide.

Conjoined twins account for between 1 in 50,000 and 1 in 100,000 live births worldwide. The condition is three times more likely to occur among females than males. A third of conjoined twins are attached at the lower chest, as in the case of the Tapia twins.

Obama raises U.S. goal on fighting AIDS (Reuters)

WASHINGTON (Reuters) ? President Barack Obama vowed to boost U.S. efforts to fight AIDS with a new target of providing treatment to 6 million people worldwide by 2013, up from an earlier goal of 4 million.

At a celebrity-studded World AIDS Day event on Thursday, Obama also challenged other nations to boost their commitments to fund treatment and called on China to "step up" as a major donor in the effort to expand access to AIDS drugs.

"We can beat this disease. We can win this fight. We just have to keep at it, today, tomorrow, and every day until we get to zero," Obama said at the forum, where he credited his Republican predecessor, George W. Bush, for his efforts to combat AIDS and HIV.

"As we go forward, we need to keep refining our strategy so that we're saving as many lives as possible. We need to listen when the scientific community focuses on prevention," Obama said.

Bush, who sought to make the fight against AIDS and HIV a signature issue of his presidency, spoke by satellite to the Washington event sponsored by the ONE campaign, an organization dedicated to fighting poverty and preventable disease.

Advocacy groups welcomed the new treatment target from the United States, the largest global AIDS donor by country, at a time when they are reeling from a funding crunch. Annual funding for HIV and AIDS programs fell to $15 billion last year, well below the $22 billion to $24 billion United Nations agencies say is needed by 2015.

"We hope this marks the end of donors walking away from supporting global HIV/AIDS, despite evidence that the epidemic can be reversed." Dr. Tido von Schoen-Angerer of medical charity Medecins Sans Frontieres said in a statement.

MINORITY GET TREATED

New HIV infections fell to 2.7 million in 2010, down from 3.1 million in 2001, while the total number of people getting life-saving AIDS drugs rose to 6.65 million in 2010 from just 400,000 in 2003, according to recent data.

But that is still a minority of the 34 million people around the world who had the human immunodeficiency virus in 2010. Studies have also shown that suppressing the virus through treatment reduces HIV's spread to patients' partners by as much as 96 percent.

As part of a goal to achieve "an AIDS-free generation," Obama said the United States aimed to provide anti-retroviral drugs to more than 1.5 million HIV-positive pregnant women worldwide by 2013.

He announced a $50 million increase in spending on HIV and AIDS treatment in the United States, where only 28 percent of the 1.2 million Americans living with the infection have it under control, according to health officials.

The funds would come from existing resources and would not require congressional approval, a White House official said.

Main manufacturers of HIV drugs include Gilead Sciences Bristol-Myers Squibb and Abbott Laboratories.

The AIDS issue seemed to prompt a rare instance of bipartisan agreement at a time when Democrats and Republicans have been bitterly divided over tax policy and spending cuts.

"Both Republicans and Democrats in Congress have consistently come together to fund this fight," Obama said. "That's testament to the values that we share as Americans, a commitment that extends across party lines and that is demonstrated by President Bush and I joining you all today."

In his remarks via satellite from Tanzania, Bush said he understood that many nations, including the United States, were struggling with their budgets. But he said wealthy nations had an obligation to make the fight against AIDS a priority.

"We're a blessed nation in the United States of America, and I believe we are required to support effective programs that save lives," Bush said.
