So here is the mystery. If the gene is not mutated in the great majority of the breast cancer patients, why are the tumors showing a low level of the BRCA1 protein? The BRCA1 gene is not unique. Many normal (perfect shape, non-mutated) genes exhibit a mysterious abnormal (increased or decreased) production of proteins in cancer.

And, breast cancer is only one example.

The Basics:

Jazz at Clippers? Easy win for the Jazz . . . provided it's anytime between 1980 and 2000. It's not anymore. Tonight's game is the last game of the 2012 calendar year for the Utah Jazz; it's our 32nd game of the NBA season -- and thus, when the new year starts we will only have 50 more in the regular season. The Clippers are at the top of the Western Conference, which is so silly that I almost feel like correcting that to "Lakers". But that's not fair and untrue. While the Lakers have had their struggles this season the Clippers have thrived. While Vinny Del Negro is the head coach it is clearly point guard Chris Paul who runs the show. The multiple time All-Star, All-NBA Player, and Olympian is always the best player on the floor on any given night. He will try to lead his team to a vaunted position of being one of only a handful of teams to have won 17 games in a row. To do so he'll have to control the pace of the game and pick us apart. Not even Deron Williams on the Jazz can hold him back anymore I think.

During this streak the Clippers have defeated the Minnesota Timberwolves, Sacramento Kings twice, us twice, the Dallas Mavericks, Phoenix Suns twice, Toronto Raptors, Chicago Bulls, Charlotte Bobcats, Milwaukee Bucks, Detroit Pistons, New Orleans Hornets, Denver Nuggets, and the Boston Celtics. It would really suck to be in the history books for being beaten 3 times in a team's historical 17 game win streak. Our 6 and 12 road record don't necessarily make this an easy game to win.

Both teams last played 2 nights ago in Utah. This will be the 3rd game in four nights for LA. The Jazz are much more rested. Hopefully our team didn't have any planned parties at clubs last night. (Miami effect)

History:

History seems to mean less and less in this new NBA. That said, the Jazz are 98 and 63 all time against the Clippers, but have a 37 and 43 record in their gym. Last season these two teams played three times, with the Jazz winning in a blowout, losing in a blowout, and losing a close game at home. This season we've played two of our four games and we've lost both times -- both were close games. Tonight will mark the third time we're playing them in December and the first in STAPLES. Luckily, we're not horrible in that gym anymore. So that helps.

Scouting, Stats, and Stereotypes:

The Jazz are known for fouling, and the Clippers are infamous for their flopping. That doesn't mean we have to call people names though. The Jazz are also known for their inside play and physical defense. While this may or may not be true, this year the Jazz are getting more from their wings and shooting (and making) more threes. Our defense may still be physical, but it's not effective. The Clippers are known (right now) for their stars, their "Lob City" play style, and for having a very talented bench. They're a really good club this year which is hilarious to me because this is the Clippers we're talking about here. It seems like in the 80s one of the staples of stand up comedy was making fun of the Clippers -- even for non-sports fans. Their culture was such that the concept of them being good was a punch line in itself.

This is no longer the case. I may not like some of the players on their team; but you can't argue with going for a 17 game win streak. It's no longer luck or a good schedule -- it's that you're a legit team and a true contender.

Clippers Injuries --

  • Chauncey Billups (PG) OUT -- Mr. Big Shot is out indefinitely with left foot tendinitis
  • Grant Hill (SF) OUT -- Grant is also out indefinitely with a bone bruise in his right knee
  • Trey Thompkins (PF) -- Trey is the third Clippers player who is out indefinitely, and the second who is out with a bone bruise; this one is in his left knee

Jazz Injuries --

  • Mo Williams (PG) OUT -- Mo Williams is out indefinitely with a sprained right thumb. He sustained the injury on December 22nd, and it's only been about a week since then. I would not expect to see him rushed back. After all, we're doing so well without him.
  • Raja Bell (SG) OUT -- Dude, he just heard about this fiscal cliff stuff and he is doing his part to make a proposal to resolve the deadlock

Advantage --

After a while it's not about who you are missing, but about the level of replacement behind who is missing. No Billups means more time for Jamal Crawford and Eric Bledsoe. No Grant is similarly bad on paper, but it means more time for guys like Matt Barnes and Lamar Odom. All four of these guys are "Jazz Killers", while the two who are out are not. No Mo Williams means . . . more Earl Watson and Jamaal Tinsley? Clear advantage for the Clippers. Especially so when Mo brings an ability to score the ball with confidence. Without him our last second play is for an awkward Randy Foye leaner.

Player Focus:

Randy Foye, man, I feel bad as this is your continued "Clippers Revenge Game Month". And with good reason, though. In two games this year you're averaging 23.5 ppg (62.5 fg%, 50.0 3pt%, 81.8 ft%), 3.5 rpg, and 1.5 apg. One could argue that the ONLY team you're playing well against (according to your season splits) are the Clippers. (You're doing okay against the Houston Rockets as well). With Mo out, and with Marvin having an ever diminished role, you really need to continue stepping up. I don't expect Randy to score 30 points tonight, but I would love to see him make an effort on defense.

We know you can shoot (sometimes). You lead the team in points last game, and came in last in +/-. You were scoring, but so was the other team. I know that Al Jefferson under-performs against larger more athletic defenders, and Paul Millsap is at the same disadvantage tonight as our "stars" go up against Blake Griffin and DeAndre Jordan. We will never know what to expect from our C4 because of their minutes. So - - - it's up to Randy Foye to be the player to focus on tonight.

X-Factors:

Bench battle. The Clippers boast a great bench. Our bench is the only reason we're in any of the games we win. Whomever wins the bench battle tonight will go a long way towards securing the victory. We already know their starters are all better than our starters. We also know they'll get the calls. They're at home. They have the stars. And they are on a 16 game win streak. The only thing we have is our bench, and theirs (when healthy) is much better than ours as well. So tonight our bench has to be even more impressive than they normally are.

We're going to need DeMarre Carroll on the floor tonight as well because God knows we have trouble guarding guys like Chris Paul and Jamal Crawford with our guards.

Word from the Badguys:

No word today -- but a word from me. Okay, I write "badguys" up there for all the teams, but we're all fans here. None of us are "badguys". The majority of the Clippers fans I know are die hards who suffered through decades of abuse. I'm sure some bandwagon fans aren't legit, but here at SB Nation the people I interact with are all loyal die hards. This includes Clippers fans as well.

So, I'll be the bad guy here and say -- let's not get into personal attacks or say mean things to people (on our team/fanbase or the other). We're all fans here. And we're supposed to be smart fans. At least, smart enough to say funny and clever things even if our team is getting beat. It's easy to get upset over a loss, and easier still to say mean things over the internet.

But we're Jazz fans. We didn't pick the 'easy' route. So doing things the easy way should be something we're predispositioned to be against. Let's do the hard thing by being great fans who are classy and nice -- even if tonight is a blowout (for either team).

As an aside:

I really don't like Blake Griffin -- but to be objective to see the tools he has, and the strides he has made as a player after only a handful of seasons means recognizing that he could be a very special player. It took Karl Malone over a decade in the league to get a face up jumper, as a point of reference. I think Blake is really close to getting something like that now, at a much younger age. (No, I'm not comparing the two -- it's hard to compare anyone to the #2 all-time leading scorer in the NBA. It's just a point that Blake is young and improving, even if I think he's a fake toughguy.)

UFC 155?s Derek Brunson was a cheerleader before he started fighting

Long before he put together a 9-2 record and earned a spot against Chris Leben at UFC 155, Derek Brunson was a cheerleader. As he shows in his audition video for "The Ultimate Fighter," Brunson was an accomplished tumbler and stunter. Skip to the 2:10 mark to see him toss his partner up into one-handed stunts and throw a double-twisting flip.

He talked about his cheerleading past with MMA Fighting, and pointed out how difficult cheerleading can be.

"I can do flips, and I was like tossing girls in the air. That's where I got my strength from, just controlling girls in the air. You get core strength, your chest gets all big. It makes you really strong, like you look on steroids, but you don't have to take steroids because of cheerleading."

Though Brunson wrestled in college, he said he did have scholarship offers for cheerleading. Wrestling and eventually MMA won out. Brunson admitted that MMA is more dangerous than cheerleading, but it's still tough.

"Cheerleading is definitely hard on your body. That's why I decided to wrestle in college, not cheerlead."

The only thing that holds it back is its inability to create a bootable rescue disk on a USB flash drive. It still creates bootable rescue disks only on optical disks, and the era when virtually every computer had an optical drive is over. If you can lie with this one minor limitation, then Genie Backup Manager is a fast, efficient, and beautifully designed application for saving and restoring data.

Interface and Options
Genie Backup Manager's main menu is elegant and informative, with big buttons leading to wizards that perform Backup, Restore, and Disaster Recovery. (The Disaster Recovery wizard creates an emergency recovery disk that you can boot from when disaster strikes.) The Backup wizard lets you create and optionally reuse backup jobs. You create these jobs in a simple interface that lets you choose a backup location either on a local disk, including optical and USB disks, or a network disk, or an FTP location, with fully up-to-date support for secure FTP if needed.

You can choose to backup items from your Windows user "profile," which means that you can select documents from your Documents folder, or media files, or Outlook data files, Windows settings and registry data, and much else. You can also choose specific folders, disks, or Windows-specific locations such as your Libraries and shared folders in a HomeGroup.

Further options let you save your backups in ZIP format or with all files readily accessible. One especially useful feature lets you create archives in the form of executable programs that you can run on computers that don't have Genie Backup Manager installed. This feature reflects the very real possibility that you won't have your backup software available when you need to restore your data in a hurry, or that you sometimes need to restore your backups on someone else's computer.

Backing Up
Genie offers you the standard choice of full or incremental backups, with an option to make your backups "mirror" the source folders, so that files that you delete on the source will also be deleted from the backup. This is a valuable backup type that works in a similar way to file synching services like Dropbox, but it should only be used with the understanding that it won't let you recover deleted files. You can also schedule backups in an intuitive and flexible way. When you've created a backup job, you can modify or reuse it by selecting it from a list in the Backup wizard. You can also modify existing jobs from the app's main menu.

If you choose this program for the non-experts in your family, you can switch to an even simpler interface that offers only the option to create and run a Backup job, or to Restore files. But if you want to use your expertise, you can click unobtrusive "More settings" buttons in the wizard interface and set up e-mail notifications of backup jobs or only of errors and other expert-level features.

Performance
Genie Backup Manager wasn't as speedy as Acronis or NTI, taking 2 minutes 45 seconds to backup an 800 MB folder to a USB3 drive?almost twice the time as Acronis?but speed isn't the most crucial factor in backups. What matters most is reliability and ease of use, because if a backup program isn't easy to use, you're not likely to use it.

I like Genie Backup Manager a lot, and if it could only create emergency boot media on a flash drive, I would happily promote it to share our backup software Editors' Choice with Acronis Backup and Recovery.

6 (Legal) Ways to 'Fix' Your Financial Statements and Pay Less Tax

The sun is setting on 2012 and your books don?t look quite the way you?d like. Maybe you have too much profit ? maybe not enough. You need financial statements that reflect reality, position you for?profits in the new year and perhaps even impress your banker or pay less tax. But how?

Fortunately, accounting rules allow flexibility: It may seem like walking a thin line but there are plenty of ways you can change your financial reporting to produce ?better looking? ? and truly more meaningful ? financial statements without ever straying into legal or ethical problems.

Let?s take a look at six situations when we have legitimate choices that significantly change our financial statements.

1.?Capitalizing Expenses

The most common way to increase a company?s apparent profitability is to shift expenses off of the P&L and onto the balance sheet. When a business makes a large purchase, it could decide the cost should be ?capitalized? ? meaning to create an asset rather than an expense. This spreads the cost across many periods (as depreciation) and increases short term profits.

There are times when capitalizing an expense is not only correct, but required.? Some costs, like leasehold improvements (building new walls in a rented office, for example), are correctly classified as an asset.? Other times, the rules are not so clear. A new phone system is clearly an asset, but how about the cost to install it and to train the staff??If the training is listed as ?free? on the contract, should we expense the value of training anyway?

The decision to capitalize expenses works both ways: increasing or decreasing expenses in one period, and increasing or decreasing assets and depreciation costs over the long term.?Capitalizing or expensing an item can be a strategic decision that impacts profits, taxes and other areas of business.

2. Time Shifting Income and Expenses

Accountants try to wrap up all the transactions in a single month or year and call that period ?closed?. But business transactions can?t be so neatly packaged. Sales and spending continue past the end of each month or year, so there is always a temptation to fudge the dates on some transactions and force them into prior or later periods.

There are some good, legitimate reasons to do this, including simply correcting quirks in the calendar.? A power bill for example, is a monthly expense.? If we do not receive the February power bill until March 1, that?s no reason to skip the expense in February.? Clearly, the February P&L should contain an expense for power, so adjusting the date on the bill is a reasonable and legitimate use of this technique.

For internal reporting ? that is, when financial statements are prepared for management and not used for tax or other external purposes ? time shifting can be an important way to smooth out revenue and expenses on periodic reports.? It can be difficult to manage a business when several large invoices land arbitrarily in one month, so assigning part or all of the expense to another month may help make sense of what is actually going on in the business.

3. Changing Reporting Periods

One month or year can show a loss, while the next shows an extreme profit.? That?s the nature of business.? In order to generate reports that show more consistency, managers may elect not to report on a strict calendar year but instead look at a more representative period, such as the last 12 months (sometimes called TTM ? trailing twelve months).? This is a respected way to characterize financial results, for example, in a fast-growing company, or toward the end of one period when the last period?s data would be out of date.

Some businesses have such variability in their monthly results that they skip monthly reports altogether and look only at quarterly results.? This makes it difficult to make real time decisions, but if the reporting is more accurate on a quarterly basis it could be a good move.

4. Revenue Recognition

Businesses with multi-month delivery cycles and big invoice values are expected ? even required ? ?to spread income out as it is earned, rather than showing it all in the month when an invoice was created. GAAP has some rules about this based on measuring the work actually completed during a period. Consult with a CFO or CPA about how to measure this!

5. Inventory Valuation

Inventory is one area where small changes in recording can have large impacts on the financial statements.? Old inventory can be ?written down? ? meaning it is devalued or discounted ? simply because it is old.? The thought is that last year?s models left in inventory are not worth as much as this year?s.? Writing down inventory is an accepted way to take an expense in the current period and adjust the cost of goods for future sales.

6. Inventory Expense Recognition

When a company sells a product from inventory, profit depends on how we calculate and recognize the cost of goods sold?(COGS).? Should we value it at the price we paid for the oldest part of it? Or the price we paid most recently for the newest pieces? Or at the price we will pay to replace it next week?

There are generally accepted rules for guiding this decision, and it is important to remain consistent.? Which method you choose ? and if you choose to change the method ? can have a substantial impact on profitability since it will shift the cost of goods.

Make the Data Useful

There are plenty of legitimate reasons for changing the way we record things on our books. The rules of Generally Accepted Accounting Principles (GAAP) provide enough flexibility to push and mold our financial statements into useful reports.

Note that I said ?useful reports?. ?I did not say tax or regulatory filings. If your business is submitting formal financial statements for legal or tax purposes, a thorough review from a knowledgeable CPA or tax attorney is always the right move.

In the meantime, remember that financial reports are meant to help you make better business decisions.? Financial statements that are knowingly false, twist reality beyond recognition, or are based on wants instead of facts, will not give you meaningful information.

Champagne loses fizz in Europe after tough year

PARIS (AP) ? Europeans are finding fewer reasons to pop open a bottle of Champagne as another year of economic troubles and high unemployment saps the region's appetite for the finer things. But while the latest industry figures show that sales might be on the wane in Europe, other markets, particularly Japan and the United States, are developing a taste for a glass of bubbly.

In what is certain to be bad news for the vineyards, France ? Champagne's largest market ? is drinking fewer bottles. Sales of Champagne for the country were down 4.9 percent, and 5 percent elsewhere in the 27-country European Union, in the first nine months of 2012 compared with the same period in 2011, according to CIVC, the national association of growers and producers of the wine.

Nineteen months of rising unemployment and growing fears that the worst is yet to come have taken their toll on France ? nearly seven in 10 French are worried about their country's future, according to a recent poll.

"The French are pessimist by nature," said Antoine Chiquet, whose family has been producing Champagne for three generations and wine for eight. "We had a difficult election, we're in an economy where Europe's foundations are being questioned."

Nonetheless, the country managed to drink 175.7 million bottles of Champagne from Nov. 1 2011 to Oct. 31 2012, according to CIVC ? enough for nearly 3 bottles a year for every man, woman and child but about 10 million bottles fewer than the previous year. In contrast, the U.S. consumed enough sparkling wine for about 1.5 bottles per person in 2010, the latest figures available from the California-based Wine Institute.

But while the news out of France and Europe is bad, CIVC figures show export sales were up 3 percent in the first three quarters of the year. Top markets included the U.S., Japan and, to a lesser extent, China. A total of 19.4 million bottles of Champagne went to the United States and 7.9 million went to Japan ? the only two countries outside Europe in the top seven export markets.

Takayasu Ogata, a Tokyo-based sommelier, said Champagne and sparkling wine consumption is climbing in Japan at a time when overall wine demand peaked about 2000. According to the French figures, Champagne consumption alone was up nearly 7 percent over a year there.

"Both individuals and restaurants are taking to Champagnes with personality, including those that are from small makers but taste good," he said.

Lower price is another reason. Gone are the days when a bottle of Moet & Chandon went for 5,000 yen ($60) or more in Japan. These days, you can get real Champagne for as little as 2,000 yen ($25).

Of course, for those with rich tastes and a budget to match there are still lots of expensive Champagnes, selling for 10 times that, according to Ogata, who works at Venture Republic, an Internet retailer, and is in charge of wines.

Beer remains the drink of choice for many "salarymen," but younger people and women are taking a liking to Champagne, Ogata says.

"It's about the bubble ? a sense of gorgeousness," he said in a telephone interview. "There's that thrill to opening up a bottle of Champagne."

China is also emerging as a potentially strong market for a glass of fizz, although the numbers remain small. In 2011, the latest figures available, it ranked 19th in export markets for Champagne, apparently because consumers are less discriminating about precise origins. According to an EU ruling, only sparkling wine made in a particular region in northeast France is allowed to carry the name Champagne. The United States makes some exceptions, as long as the labeling is clear.

"People enjoy the 'boom' moment of opening sparkling wine. It is fun. It offers a more festive atmosphere and it tastes good," said said Yu Ming, a 29-year-old who operated a bar in Beijing's Sanlitun nightlife district until 2010. In China, he added, "people call all sparkling wine Champagne. They don't care where it is from or whether the fermentation is inside the bottle."

The sales manager at the BHG supermarket in a luxury shopping mall in Beijing confirmed that Champagne budgets are largely out of reach in China, saying most customers at the chic store will instead choose sparkling wine: "The most expensive Champagne is 7,800 yuan ($1,250) a bottle at my store, but the most expensive sparkling wine is only 268 yuan ($43)," said the manager, who gave his surname, Hou.

Chiquet, whose label Gaston Chiquet produces about 200,000 bottles a year, said France and Europe generally will remain the most important markets for Champagne. But for the numbers to climb again "we'll have to rediscover optimism."

"Champagne remains a drink for celebrating the big events of life," said Chiquet. "Happily for sales, at the end of the year, the French rely on tradition. Still, we're not going to catch up. Unfortunately, what's lost already is lost."

Marketers need to harness media convergence and integrate to maximize the impact of their various communications, on and offline.

Convergence has been brought about by the arrival of mobile and social media. The combination has empowered customers to access the Internet anywhere and discuss it.

The resulting anytime anywhere access to the Internet breaks the isolation of any one type of media form, including radio ads in the car and newspapers in a local subway.

Convergence creates the need to integrate, the process in which all communications from a company or organization ? regardless of form ? work together to present a unified brand experience for a customer. Integration yields more leads, creating better ROI for marketers. It includes cross promotion of ideas, themes, and calls to action, including participation in social media.

A recent CMO Council study showed that only 9% of respondents believe their interactive marketing efforts are highly evolved and integrated. More marketing dollars are being invested in direct tactics like email marketing, direct mail, search, and more first. That?s because the direct marketing approach yields the most ROI at a 10:1 ratio, according to the Direct Marketing Association (DMA).

Break that direct expenditure further into the online spend. More than half of expenditures (54 percent) in Internet marketing go to online pay-per-click search in 2011, says the DMA.

Inbound marketing closes with customized dynamic online calls-to-action and emails. But even a letter or an old fashioned mailer can achieve the same result.

New laws address gays, children, immigration

Measures on gay rights and child safety are among the top state laws taking effect at the start of 2013, along with attempts to prevent identity theft and perennial efforts to restrict abortion and illegal immigration.

In many states, new laws take effect on Jan. 1, while in others they do so 90 days after a governor's signature.

Voter-approved laws allowing same-sex couples to marry take effect in Maryland in January and in Maine on Saturday. California also approved a law exempting clergy members opposed to gay marriage from performing same-sex marriage ceremonies.

In California, a first-of-its-kind law bans a form of psychotherapy aimed at making gay teenagers straight but is on hold during a court challenge. The law would ban what is known as reparative or conversion therapy for minors; such therapies are widely discredited by medical professionals.

A number of laws seek to protect children from bullying and abuse. Pennsylvania school employees in contact with children, who already must report suspected abuse, must now be trained to recognize the warning signs, their legal obligations and what are considered appropriate relationships with children.

That law was being debated and voted on in June as a jury was finding former Penn State assistant football coach Jerry Sandusky guilty of 45 counts for sexually abusing 10 boys over 15 years.

California coaches and administrators in K-12 schools, as well as higher education employees who have regular contact with children, will be required to report suspected child sexual abuse. Oregon will require schools to adopt a policy on teen dating violence, a law that follows state legislation earlier this year requiring school employees to report acts of bullying, harassment and online bullying.

In Florida, the Safe Harbor Act includes provisions that require police to turn over to the Department of Children and Families any children who are alleged to be sexually exploited or dependent for assessment and possible shelter.

States continue to wrestle with illegal immigration. Pennsylvania will include a requirement that contractors on public works projects make sure through the federal E-Verify system that their employees are legal U.S. residents, while a Montana ballot measure taking effect denies illegal immigrants of state services.

Supporters say the Montana law will prevent illegal immigrants from obtaining services and prevent them from taking jobs at a time of high unemployment. Opponents argued there is no proof illegal immigrants are using state services in Montana.

Also in Montana, voters overwhelmingly passed a measure requiring parental notification for minors' abortions, while in Georgia a new law will prohibit doctors from performing an abortion 20 weeks after an egg is fertilized unless a pregnancy is determined to be medically futile, meaning it would result in the birth of a child unlikely to survive because of a serious defect. Georgia became the seventh state in the country to approve the so-called fetal pain act.

"Today, we are reaffirming Georgia's commitment to preserving the sanctity of all human life," Gov. Nathan Deal said in a statement released shortly after he signed the bill in May.

The measure passed over the objection of many female lawmakers, including Sen. Valencia Seay, who said the bill's passage and signing was "unconscionable, but not surprising" and typical of the male-dominated General Assembly.

New Hampshire enacts a ban on a type of late-term abortion procedure sometimes called "partial birth abortion" after lawmakers overrode the veto of Gov. John Lynch, who said the measure was unnecessary because federal law already prohibits such procedures. Supporters of the ban say they don't trust the government to prosecute the law.

In Maryland, parents will be able to freeze their child's credit at any time if the child becomes a victim of identity theft. "This just freezes the information to ensure that it's not used for ill purposes," said Delegate Craig Zucker, a Democrat who sponsored the bill in the Maryland House of Delegates.

In Delaware, state officials must request an annual credit report for every child in foster care.

Among other new laws:

? Alabama begins cracking down on the state's 900,000 uninsured drivers with a new system that allows instant checks by police, license plate offices and the state Revenue Department.

? A pair of laws in Georgia and Pennsylvania address the shortfalls faced by some states from the cost of unemployment benefits by raising employers' contributions to unemployment compensation trust funds.

? In New Mexico, drivers registering their car or truck will be able to donate $1 or $5 to a state fund that supports programs and services to veterans, such as assistance in finding a job or treatment of post-traumatic stress disorder. In Utah, U.S. military personnel will be exempted from having to pay a full year's property taxes after their return from 200 days of active duty in any calendar year.

? In Florida, it will no longer be illegal to flash your headlights to warn oncoming drivers that police are lurking on the roadside ahead. The legislation was introduced after drivers were ticketed for warning other motorists that officers may be trying to catch speeders on the highway.

? A California law bans the use of dogs when hunting bobcats or bears, while Wisconsin's expansion of its hunting seasons in state parks to a month in autumn and another in April was a scaled-back version of a proposal that would have allowed hunting across a seven-month period from mid-October to late May. Residents reacted to the longer proposal with thousands of angry letters and emails.

Most people who opposed the measure said they would stop bringing their families to state parks if there were a chance of being struck by a stray bullet or of a pet straying into an animal trap. Supporters countered that hunting has long been a Wisconsin tradition and that hunters were well-versed in practicing safe techniques.

Former Braves player arrested on battery charge

DULUTH, Ga. (AP) ? Former Atlanta Braves star center fielder Andruw Jones was free on bond after being arrested in suburban Atlanta early Tuesday on a battery charge, according to jail records.

Around 1:30 a.m. Tuesday, police responded to a call for a domestic dispute between Jones and his wife in Duluth.

Gwinnett County Detention Center records say Jones was booked into the jail around 3:45 a.m. and had been released on $2,400 bond by 11 a.m.

Once one of the premier players in the big leagues, Jones broke into the majors with the Atlanta Braves in 1996 and won 10 consecutive Gold Gloves from 1998-07 as their center fielder. He has 434 career home runs over the span of 17 seasons in the majors.

Jones earlier this month signed a $3.5 million, one-year contract with the Tohoku Rakuten Golden Eagles of Japan?s Pacific League.

U.S. retailers scramble after lackluster holiday sales

(Reuters) - The 2012 holiday season may have been the worst for retailers since the financial crisis, with sales growth far below expectations, forcing many to offer massive post-Christmas discounts in hopes of shedding excess inventory.

While chains like Wal-Mart Stores Inc and Gap Inc are thought to have done well, analysts expect much less from the likes of book seller Barnes & Noble Inc and department store chain J. C. Penney Co.

Growth was always expected to slow this season, though an improving employment picture and rising home values had helped mitigate the worst fears. But then Superstorm Sandy hit the East Coast in late October, mild weather blunted sales of winter clothing and rising concern about the "fiscal cliff" became more of a reality, dragging down already pessimistic forecasts.

"The broad brush was Christmas wasn't all that merry for retailers, and you have to ask what those margins look like if the top line didn't meet their expectations," said Kim Forrest, senior equity research analyst at Fort Pitt Capital Group.

The latest sign of trouble came from MasterCard Advisors Spending Pulse, which reported holiday-related sales rose 0.7 percent from October 28 through December 24, compared with a 2 percent increase last year.

The preliminary estimate from SpendingPulse was in line with other estimates showing weak growth during the holiday season, when retailers can book about 30 percent of annual sales -- and in many cases, half of their profits.

"It has been a very uneven industry performance, probably at least for the last year, and that certainly continued into the holiday season," said Michael Niemira, chief economist at the International Council of Shopping Centers, in an interview with Reuters Insider.

The latest holiday season could end up the weakest since 2008, during the last recession, when sales actually declined. The National Retail Federation had previously predicted 4.l percent sales growth this year, versus a 5.6 percent increase a year earlier.

Markets reacted sharply to the gloomy outlook.

The S&P retail index fell 1.8 percent in midday trading Wednesday, and 16 of the top 20 decliners in the broader S&P 500 were retailers or consumer brands.

INVENTORY CRUSH

To be sure, the actual percentage change in holiday sales can differ substantially, depending on which group is composing the figure. SpendingPulse and the National Retail Federation, for example, look at different categories, which can cause some variation in their forecasts.

Regardless of how bad the figure is, one concern for retailers is that soft sales will mean an excess of inventory that will force some to slash prices.

Among other brands, Barnes & Noble offered 50 percent discounts in stores via email promotions on Wednesday, while Ann Inc had half-off at its Loft stores, and Bloomingdale's promoted discounts of up to 75 percent in some cases.

Even in a good year, retailers would have offered discounts to lure customers, but some suggest a weak year has now forced their hands.

"Retailers are no longer chasing sales, they are chasing inventory management. That means the discounts that they would have liked to be at 50-60 (percent) off have climbed to 75 to even 80 (percent) off," said Marshall Cohen, chief industry analyst at The NPD Group.

Erica Ayala, 31, a mother of four who lives in New York's Harlem neighborhood, waited until the day after Christmas to shop for that very reason, saving more than $150 on kids' clothes alone at Gap's Old Navy chain.

"You can't go wrong with that," she said.

SANDY AND CLIFF

A variety of factors were thought to be at fault for the weak season, starting with Superstorm Sandy, which depressed sales in the Northeast in late October and early November.

Sales recovered in the second part of November, with early hours and promotions helping drive traffic during the "Black Friday" weekend after Thanksgiving, analysts said.

But there was a deep lull in early December as a winter storm in parts of the United States may have limited sales, said Michael McNamara, vice president of research and analysis at MasterCard SpendingPulse.

On top of that, there were fears that taxes will rise in the new year if Washington cannot negotiate a solution to the end-of-year "fiscal cliff" dilemma.

A recent Ipsos poll for Reuters found that only 17 percent of shoppers were spending less due to cliff fears, though analysts said the damage was still done.

"The government usually does not have a role in holidays but this year they did. They got right in the midst of it, the timing couldn't have been any worse," NPD's Cohen said.

BRIGHT SPOTS

One bright spot has been online sales, which continue to grow at a faster pace.

On Christmas Day, online sales jumped 22.4 percent, outpacing the 16.4 percent increase in 2011, according to IBM Digital Analytics Benchmark, which tracks more than 1 million e-commerce transactions a day from 500 U.S. retailers.

Whether online or off, some of the winning retailers were expected to be Wal-Mart, which attracted shoppers with early deals on the night of Thanksgiving and kept its focus on value, and apparel chains like Gap Inc, whose bright sweaters were successful, according to analysts.

Toys sold well, and hot items that were harder to find later in the season included certain Mattel Inc Barbie dolls and LeapFrog Enterprises Inc's LeapPad2 tablet computer, according to B. Riley Caris analyst Linda Bolton Weiser.

For retailers who have struggled, analysts said all hope was not lost. Many have fiscal quarters that end in January, so they still have time to benefit from a post-Christmas rebound. Because Christmas fell on a Tuesday, some said they could even see a boost this week from people who have extra time off.

"There's still a little bit more time to go until the holiday season is officially over," Morningstar analyst Peter Wahlstrom said.

Why are (Smart) Investors Buying 50 Times More Physical Silver than Gold?

As long-time students of precious metals investing, there are certain things we understand. One is that, historically, the availability ratio of silver to gold has had a direct influence on the price of the metals. The current availability ratio of physical silver to gold for investment purposes is approximately 3:1. So, why is it that investors are allocating their dollars to silver at a much higher ratio? What is it that these ?smart? investors understand? Let?s have a look at the numbers and see if it?s time for investors to do as a wise man once said and ?follow the money.?

Average annual gold mine production is approximately 80 million ounces, which together with an estimated average 50?million ounces of annual recycled gold, totals around 130 million ounces available per year. In comparison, annual mined silver production has averaged around 750 million ounces, while recycled silver is estimated at 250?million ounces per year, which adds up to approximately 1 billion ounces. Using this data, there is roughly 8?times more silver available to buy than there is gold. However, not all gold and silver is available for investment purposes, due to their use in industrial applications. It is estimated that for investment purposes (jewelry, bars and coins), the annual availability of gold is roughly 120 million ounces, and of silver it is 350 million ounces. Therefore, the ratio of physical silver availability to gold availability is 350/120, or ~3:1.1

Now, let?s examine how investors are allocating their investments between gold and silver. The data below is from the US Mint showing gold and silver sales in ounces:

As you can see, investors are choosing to buy silver at a ratio to gold that is well above what is available. This uptrend doesn?t show any signs of slowing either. The ratio of the physical silver to gold is both rising and extraordinarily above the availability ratio of 3:1.

We can also use other data such as the most recent issues of the Sprott Physical Gold and Silver Trusts. The last Gold Trust issue in September 2012 raised US$393 million and the last Silver Trust issue raised US$310 million. On the basis of prices for each metal at the time of issue, we could purchase ~213 thousand ounces of gold and ~9.1 million ounces of silver. This represents a purchase ratio of 43:1.

If we examine ETF holdings in both gold and silver, we note that in the period from 2007 to 2012, the increase in silver holdings amounted to 12,000 tonnes, compared to 1,200 tonnes of gold ? meaning, investors purchased ten times more silver than gold.

These are only three factual data points to consider, but there are other indications that silver investment demand is way out of line with availability. Our favourite question to the bullion dealers we meet, is to ask the ratio of their dollar sales in gold versus silver. The answer is that dollar sales are equal, which means that physical silver sales relative to gold are greater than 50:1.

A recent news headline on Mineweb read, ?Silver Sales to Outshine Gold in India.2? It went on to quote a bullion dealer that ?investors and jewelry lovers prefer silver jewelry these days.? As the largest importer of gold in the world, it would be impossible for India to purchase an equivalent amount of silver, as it would require more than one billion ounces, essentially more than the current annual mine production.

While these last two confirmations of silver demand are anecdotal, the statistics from the US Mint, the ETFs, and our Physical Trust issues, are factual.

For the time being, the silver price is essentially set in the paper market where the daily average trade on the Comex is approximately 300 million ounces. An outrageous number when you compare it to the daily mine production of about 2 million ounces. As Bart Chilton, Commissioner of the Commodity Futures Trading Commission stated on October 26, 2010, ?I believe there have been repeated attempts to influence prices in silver markets. There have been fraudulent efforts to persuade and deviously control that price. Based on what I have been told and reviewed in publicly available documents, I believe violations to the Commodity Exchange Act have taken place in the silver market and any such violation of the law in this regard should be prosecuted.?3

Which brings us back to the phrase ?Follow the money.? In our view, it is almost inconceivable that investors would allocate as many dollars to silver as they would to gold, but that is what the data shows.

The silver investment market is very small. While the dollar value of gold in the world approaches $9 trillion, the value of silver in the forms of jewelry, coins, bars and silverware is estimated at around $150 billion (5 billion ounces at $30 per ounce). This is a ratio of 60:1 in dollar terms.4

How long can investors continue to buy silver at the current ratios when the availability for investment is only 3:1? We are surprised that the price of silver has remained at such a depressed level compared to gold. Historically, the price ratio between gold and silver has been 16:1, when both were currencies. Today the ratio is 55:1, so what are the numbers telling us? We believe this is one of those times when smart investors will be well rewarded to ?Follow the money.?
